Judge Kurt Eisgruber tells raped wife she needs to forgive husband, zero prison time for husband


Man Found Guilty of Drugging and Raping Wife Gets No Prison Time

His wife was “snippy” and drugging her “made her nicer” is how an Indianapolis man convicted of repeatedly drugging and raping his wife explained his actions in court. The offenses, carried out over the course of three years, netted Indiana resident David Wise a grand total of zero years in prison after a trial in which he was found guilty.

Mary Boardman says she confronted her husband about his suspicious behavior, and her mysterious drug-induced sleepiness, before reporting him to the police along with videos he had taken of the rapes, according to the Indy Star. “I was taking advantage of you in your sleep and you kept coming to me and telling me it was NOT ok,” Wise explained to her in an email. “I needed to stop.”

The jury who heard the case against Wise apparently agreed, finding him guilty of six felony counts, including rape and criminal deviate conduct. Each of those might normally come with six to twenty year sentences, Marion County Deputy Prosecutor Courtney Curtis told the Los Angeles Times.

The judge in question, Kurt Eisgruber, apparently didn’t think it was all that serious of an offense, applying a 12 year suspended sentence, and eight years of home detention pls two years probation. As if that weren’t insult enough, Eisgruber told Boardman, who, again, was repeatedly rapd and drugged by her own husband, that she needed to forgive him. He explained to the Times:

“I hope that you can forgive him one day, because he’s obviously struggled with this and struggled to this day, and I hope that she could forgive him. “Ultimately, I think that helps a lot of people heal — it helps them to reach that point,” Eisgruber added. “Some can, some cannot. I’m not in her shoes, I’m not able to say one way or another … It’s not something that’s limited to her or this case. But when people are really struggling, I just offer that out. … I just hope that they find peace.”

That's preached over and over to victims, how about justice? Where does that come in.

The demand for forgiveness by victims has gone way over the top. Justice is this judges business, not what he perceives as this woman's soul. Whether she forgives or not is none of his business.

not defending the judge in the slightest -- i'm baffled by as to how an open-and-shut case of repeated rape and multiple guilty verdicts doesn't manage to result in even a measly 30 days of mandatory prison time, and the whole thing about forgiveness is, well, unforgiveable.

but just to point out, I assume that "12 year suspended sentence" means that if he violates the terms of the 8 years home detention and/or the subsequent 2 years of probation, then the suspension of the 12 years prison sentence could be lifted and he would then have to go to prison.

again, not saying that this is an appropriate sentence, just saying that it will be a decade before we know if he actually avoids all prison time.

She learned about rape through cellphone videos in 2008. She got a divorce in 2009. She complained to the police about harassment in 2010. But she didn't report the rapes until 2011; her explanation is that she didn't want their children to grow up without a father

So the judge might have reasoned as follows: she apparently didn't sustain any injuries requiring medical attention at the time; she wasn't outraged enough to complain to police in 2008; she apparently wasn't angry enough to raise the matter in her divorce; she apparently wasn't outraged enough to bring the matter to police police attention at the time of her 2010 harassment complaint; and for years, she apparently wasn't concerned enough to attempt to limit his visitation with the children; so we'll give the guy a suspended sentence plus house arrest, and if he fails to wipe his nose someday, he's facing a long stint in the slammer
