BROWNSVILLE - A militia member who came under Border Patrol gunfire Friday is a convicted felon.

The man, John Frederick Forester, is part of a group camped out on private land near the river.

Officials said Forester was armed when a Border Patrol agent opened fire on him. ....

The group's commander said they only check to see if applicants are on probation or parole.

The commander said the group is contemplating suing the federal government and the Cameron County Sheriff's Department over the shots-fired incident.

The group's leader said the agent opened fire before identifying who they were. He said the sheriff's department is mishandling the investigation ....

"I'm still going to be out there. I'm still going to be vigilant. I might be a little louder towards the agents so that they know that I'm there. I might even put a red strobe light on my forehead so that they can see. I'm not leaving," he said after the shots-fired incident.

.... Border Patrol officials, on the other hand, said they did not know the armed citizens were patrolling in an area where they were chasing illegal immigrants.

"I approached the Border Patrol officer and I said, ‘what's going on?' He told me that they were actively having illegals being pushed toward our position. He requested that we assist," Massey said.

Massey said the group was willing to ignore the shots-fired incident.

"We, as a team, even said no harm no foul. We're not going to say nothing if you say nothing," Massey said.

Massey said that, as American citizens, his group has the right to detain illegal immigrants.

"It's called a citizens' arrest," he said.

Federal officials say forced detention can be viewed as a criminal offense.

Massey said the feds and his group have the same goal.

Border Patrol officials think otherwise. ....

who was in camo and on private property and in the dark of the night POPPED UP out of nowhere, ARMED and the BP fired on him.

Did I mention that in the heat of the moment there might have been ARMED SMUGGLERS out there?!1

They aren't on the gov payroll like the US Border Guards are, unless they're collecting welfare or disability from the gov. Who is supporting their families back home while the kkk militia is sitting there waiting for someone to cross into the USA so they can shoot them?

A convicted felon caught brandishing a firearm thought it was a good idea to go trash talk the US Border Patrol for doing their job. I bet he regrets his smack talk now, or maybe not. This one isn't exactly the brightest crayon in the box.

(honestly, it could have been simply for being a drug user.) But it should have prevented him from getting a gun.

He was certainly an "up-standing" citizen, at least for a few moments before the bullets came his way

Who knows, they may have a pool of guns down there they let their militia members borrow to perform their duties? I doubt it, but it's possible.

As for his being a felon, the only issue I have with it is that he was in possession of a firearm. Well, that and he was stupid enough not to realize that it was not a particularly great idea to be in illegal possession of a firearm while down playing like you're picking up the slack of the US Border Patrol. If I'd have been in his shoes (as if I'd ever do something like that!) I'd have been as polite and respectful to the legit Border Patrol as possible. I'd have apologized for not making myself known to them. Thanked them for not shooting me dead and then tucked tail and hauled butt. I'd have told my buddies how the whole incident was my fault and I had to leave immediately to spend more time with my family, or that I'd just found out my ferret was diagnosed with cancer and I have to get home right away or something. Anything but egged my pals on until they're talking about suing the federal government and the local sheriff's department bringing more attention to me, the felon who just got caught committing a federal offense. Instead he even took it so far as to do interviews with with the media there saying, ""I'm still going to be out there. I'm still going to be vigilant." I can't help but wonder if he thought he sounded like Schwarzenegger in Terminator uttering his "I'll be back" catchphrase with that one.

What I mean is, my issue isn't with his being a felon, but rather with him being a felon in possession of a firearm while pretending like he's some kind of law enforcement. I also have an issue with his being dumber than a box of rocks. Yeah, that pretty much sums up where I'm at on this one.

Although, to be honest, I'm glad he's "shooting his mouth off" because of the unwelcome attention it brings to him and his buds. The Feds will "shoot them down" in court, and then they'll have a bill for court costs to pay, too

No person except a law enforcement officer can arrest any one for violation of a Federal law. Also the illegal immigrants are not committing a crime, but a civil infraction which Federal agents can detain them for, but no one else can.
