Jennifer Lawrence's attorney is locked in a battle with bosses of a porn website over the copyright of leaked intimate photographs of the actress. The "Hunger Games" star hit headlines Sunday when nude pictures of her were leaked on the Internet along with a number of other female celebrities including Kate Upton and Kirsten Dunst, reports tmz.com.
Lawrence's representative blasted the "flagrant violation of privacy" and threatened legal action against anyone who shared the snaps. America's Federal Bureau of Investigation (FBI) is investigating the scandal.
Since the leak, Lawrence's attorney has embarked on a battle to remove the pictures from various websites, but bosses of one porn site have refused to take them down because the actress does not own the copyright to the entire set.
The site's officials are arguing that not all the pictures were taken by Lawrence, so whoever snapped the shots owns the copyright. They are demanding proof of the actress' rights or the name of the photographer.

(25,919 posts)I just had a thought this morning. I don't think Lawrence's lawyers will have much success going after the copyright angle. (As Righthaven found out when they went after DU, if you're going to charge a website with copyright infringement, you have to be able to document ownership of said copyright.)
However, if the government were to step in and say that these pictures qualify as "sexually explicit" (or whatever the appropriate term is), then the 2257 record-keeping requirement could be invoked. Obviously these websites don't have those records, so...
At this point, I'm not sure what the law would decide. Does the website automatically get shut down, or can they reveal who gave them the pictures, and have the government make the 2257 request of them? Eventually, that chain will end with the hacker, so either someone will have to turn the hacker in, or the websites will have to admit to posting pictures without the necessary records.
For that matter, could Lawrence's lawyers make a 2257 request? I've heard of some lawyers doing that in copyright trolling cases, although I don't think they've had any success yet.

(3,732 posts)downloaded the entire "Fappening" collection to his personal computer, so he will have it forever. I'm sure many guys have done the same. Making a moral argument about it falls on deaf ears.
I suppose the lesson here for celebrities and women alike is to not keep your photos risque photos anywhere they could be leaked online. Personally, I wouldn't take them at all: if you break up with the guy, and he has control of the photos, he might choose to place them online.
Some might say this is the same as telling women not to dress in certain ways because of male bad behavior. I don't think it's the same issue at all. If a man harms you, you have legal recourse no matter what you were wearing. If you lose control of risque images, you have no realistic recourse: there are too many places those pictures can go. There are too many copies.
If women don't want their image to become an object to be used for just any guy's "satisfaction", they will stop putting their pictures in places they could potentially lose control over them.

Because the entire collection is on torrenting sites like the infamous pirate one. These photos are out there for good on the internet.
I do not blame the victims of a hacking. I do point out the responsibilities of being an adult with private material like self porn in the digital age. Nothing is safe and secure. Nothing once out there ever disappears especially if it is kitten photos or naked women. It is the sad nature of the beast.
If she was smart or at least had a great publicist, she should pull a Marilyn Monroe and morph this 'leaked scandal' into a managed persona event.
