(82,849 posts)This is one of those things that libertarians like to point to and say, "What the hell? We need a law for this? Nanny state!" But yeah, we need some of these laws on the books, like driving on the right side of the road and not on the sidewalk, or keep your intimate relations out of the public eye. We have to do this because some people can't handle freedom and definitely need to be told what to do: "There's no law against it!" is the rallying cry for the antisocial schmucks who would otherwise make society unlivable for the rest of us who know how to behave.

(31,464 posts)I'm currently through a big FB debate with friends in my old home town. Some in the community are looking to ban cigarette smoking and drinking on the beach. I ask "What harm does it do to you?" Well...it actually physically harms my health (second hand smoke) and risks my life when the drunken beach goers try to go home. But what about sex? How does it harm you? Last I checked, you don't have a right to not be uncomfortable. No one is "harming" you, you just don't like it. Your parents and/or preachers taught you sex was icky, but it certainly doesn't harm you.

(31,464 posts)We were talking about the "Libertarian" view of freedom. If you're not harming anyone, the government has no say. Personally, I know people who wouldn't care less if they left the potty door open. Does it HARM you? Is anyone forcing you to look at him/her pee? No, it doesn't HARM you, it just upsets you.
So, should ANY law that doesn't physically harm you be repealed? Or can you accept that sometimes we make laws out of purely puritanical, aesthetic reasons, as opposed to just limiting laws to defense and funding issues?

It has not always been the case that these things have been considered private things - in Ancient Rome, pretty much everyone defecated and urinated in public, in common latrines. However, right now, in our culture, we reject that.
You are free to work towards a society where having sex in public is considered ok, and not forbidden by any law. What you may not do, is break the laws society has enacted wherein they made having sex in public illegal. We haven't given our consent to having to see that.

(29,503 posts)I asked because there is another story active here in which members of the public (at the time of arrest) are reportedly giving witness to an account of events that do not mirror the accused's account, i.e., that she was engaging in sex in public.
That said, I do think everyone should be given a kind of unofficial 'pass' on occasion for an indiscretion here or there.

Here in SF I have witnessed this more times than I care to (and I'm not talking about events where folks pretty much know there is going to be public sex) and get REALLY pissed off when I have. There are plenty of safe places to have public sex where everyone around you will be a willing participant. I do not consider the lawn in front of the Conservatory of Flowers in Golden Gate Park on a Sunday with families playing a few yards away from you to be the appropriate place.

Now, if it's a private gated community or hippie commune where public screwing is the norm, that's different. I chose to go there, so I chose to risk seeing a kid jump over two guys humping on the Green because he was chasing a Frisbee. (No, I didn't see this, but a friend of mine who lived in a hippie commune like this did have this happen to her son. He wasn't scarred or anything, he didn't even know what they were doing.)

But our society as a whole has settled on a norm that it is unacceptable for people to engage in such behavior in public, and I am pretty sure that any opinion poll or survey would confirm this. Handholding, kissing, etc. has been deemed to be acceptable but anything involving the genitals, unacceptable. And I am quite prepared to go along with the level of prudishness that society has settled upon.
