as jury options. Therefore, they should have been included as poll options, no?

I'm not a legal expert, just an observer like everybody else. Wasn't aware that Florida law allows for that.

So don't feel bad. Everybody is just using the other option for it and explaining their vote so it's working out fine. What else could other have been anyway? You listed all the other options clearly, plus it's a good way to kick the poll up.

I don't believe I've definitely stated that. I have stated that it's POSSIBLE the prosecution overcharged in order to get a plea deal and wrap this thing up. I have also stated that it's POSSIBLE the prosecution feels the evidence is strong and there is a good chance of a conviction. Funny how you left that last part out.

Since I neglected some relevant options on this poll, it's pretty clear I'm not an expert on Florida law or the judicial system at large. But if we only posted about things we know lots about, this place wouldn't be nearly as interesting, would it? My opinion is that a conviction for second degree murder will be difficult. But I don't know that for sure, it's just a guess.

Florida juries are free to consider lesser included offenses.

A manslaughter conviction is likeliest, IMO.
