A loophole in the federal system currently allows people to buy firearms sold online and at gun shows without first passing a background check.


That statement is just plainly not true. Any dealer that has an FFL has to do a background check to include gunshows. Any firearm ordered online that crosses state lines has to be shipped to an FFL and a background check completed at point of pickup of the firearm. That is federal law now.

Of course if you are in the same state, an intrastate transfer is covered by state law and some states do include background checks for those transactions.

Facts matter, and I wish the great and wonderful press would at least be factual in the story.

How about we open up the NICS to private individuals and give them a go or no go to keep with the bill of sale?

Late last year President Obama started a policy to help shore-up the flagging NICS database. Considering most of the rampage shooters in the last several years were known to the LE community yet passed a BC shows the system has been neglected almost to the point of dereliction of duty. That Congress pretends to care yet allows this state of affairs speaks volumes.

Only they will challenge it as a violation of the 10th Amendment with the argument that the Federal government has no right to regulate in state commerce.

Of course be careful what you wish for, both sides will try to get amendments attached to it, including some you might not like, such as national recognition of CCW permits, forcing states like NY or NJ or CA to allow non-residents from Montana or Texas or Florida to carry firearms when visiting NY, NJ or CA.

It had a pretty damn good chance last time, till she just had to slap an AWB on there. Reality matters and reality is, any discussion aside, an AWB is a poison pill in the current environment.

Shit, look at the furor over banning one specific (overpriced inaccurate) brand of .223…

I can agree with it in principle, but until they drop any further gun control legislation (AWB, magazine restrictions,
etc), and demonstrate some good faith, and willingness to compromise by repealing some existing laws, I'll
continue to oppose it.
