(12,504 posts)I was referring to the portion of the Constitutional act of Treason that can only happen while the US is at war. Congress has not declared war on Iran.
"The Treason Clause applies only to disloyal acts committed during times of war. Acts of dis-loyalty during peacetime are not considered treasonous under the Constitution" http://legal-dictionary.thefreedictionary.com/treason
Again, I welcome discussion.

ANYONE who isn't trying to undo the damage at this point is a war-criminal, an enemy of all humanity, a traitor, a worthy substitute for Satan.
FUCK THE BIG TENT. DEMOCRACY IS DYING. YOU'RE EITHER WITH HUMANITY OR YOU'RE THE DEVIL.
Any compromise with evil IS evil.

(12,504 posts)Is this a traitorous act? I actually don't think so. The Constitution has been clarified, that one can ony act as a traitor during times of war and the USA is not currently at war with Iran.

Again, I welcome discussion...if you can try and hold back the insults, perhaps you may even learn a little something.
Clearly the 47 Senators suck big time. They are nasty, made the USA look bad in international eyes, they are dis-loyal and undermined the whole peace process. Which is not too surpriseing since they are the party of war. Hollerin' about treason, when it may not actually fit the circumstances, just makes Dems look foolish.
So, I read that there is a high level of disloyalty. What is the protocal for such acts?

(151,269 posts)In the first place, prosecuting sitting Senators for something like this would not result in anything but keeping the issue in the media. IN the second place, prosecutions for treason are rare, since the definition for treason is very specific, and nothing in it has anything to do with the letter sent by those Senators.
Federal prosecutors, in dealing with elected officials, particularly Presidents, Senators and members of Congress, are extremely hesitant to prosecute, and for very good reasons. It's not going to happen, because such prosecutions would threaten the very structure of our government.

(114,904 posts)This is not treason under the law. And that has shit to do with corruption. Are you actually calling Obama corrupt because his administration CAN'T prosecute? This would be thrown out of court so fast, you're head would spin.

FFS.
The Republicans spoke with just1voice in that letter. Why don't you castigate them for their actual actions? Why are you so eager to shift blame from the real assholes in this incident?
