BALTIMORE Charged cops: Remove her!!!

Freddie Gray case: Defense attorneys call for prosecutor to be dismissed

http://us.cnn.com/2015/05/08/us/freddie-gray-case-dismissal-motion/index.html

Attorneys for the six Baltimore police officers charged in the death of Freddie Gray want the case dismissed or State's Attorney Marilyn Mosby's office to be taken off the case.

A lengthy motion filed in Baltimore City District Court cites a variety of concerns, including conflicts of interest and questions about the office's independent investigation.

It spells out five conflicts of interest as reasons for the requests. The attorneys say in their court filing that:

-- Mosby and her husband, City Council member Nick Mosby, stand to gain financially and politically;

-- She has personal relationships with potential witnesses;

-- Her office took a role investigating the case;

-- There is a pending civil lawsuit against her office;

in general, their clients may be in for a world of hurt.

But never attack a criminal defense lawyer for what they do, they may need to do it for you someday

Might be enough for her recusal from the case as there are connections. The charges will stand, but further investigations would be handled by an independent prosecutor or by a prosecutor from a neighboring jurisdiction.

At any rate, the defense counsel needs to stir things up enough so that it stays in the papers and becomes grounds to remove the trial to Hagerstown or Annapolis.

Criminal cops, especially those who hunt and murder minorities, are above the law. Don't you know any better?

independent investigations, now, would you?

The Baltimore PD is more than capable of investigating itself. Results guaranteed.

But I think it's worth looking at it from a different perspective. If her office had said "no charges", and any of the above were true, would we be saying "conflict of interest, she needs to be removed from the case? I'm betting we would.

Also, while I agree 100% that her office had a duty to conduct an investigation, it's been reported that the man leading that investigation has every reason to have a grudge against the Baltimore police department.

Finally, I see no way this will be tried in Baltimore...I can't see any judge allowing that to happe.
