as a way to handle anything. But you are spot on that Texas does this all the time, especially if they are black or hispanic.

you know, the one who (until recently) held the record for most number of Death Row inmates put to death on his watch, instead of making the sentence (which, actually, is far crueler) "life, no parole" ...
Oh, and he's the one who made sure that an accountant, instead of a doctor or a member of the family, can decide who stays on life support and who doesn't ... in Texas ... the originator of the "Death Panels" ...
