Kentucky clerk petitions for governor to excuse her from issuing same-sex marriage licenses

Lawyers for jailed Kentucky county clerk Kim Davis said on Monday they had asked an appellate court to force Governor Steve Beshear to let her refuse to issue same-sex marriage licenses based on her religious convictions.

The lawyers sought emergency relief from the 6th Circuit Court of Appeals, asking it to grant Davis an exemption from the “Governor’s mandate that all county clerks issue marriage licenses,” the non-profit legal advocacy group Liberty Counsel, which represents Davis, said in a news release.

My Step-Mom thinks should be allowed an accommodation. I am torn on this. Maybe if she didn't act like a jerk I would lean a little more towards it BUT then I am thinking after all the BS she caused she should be fired.

I have seen businesses and even local government office accommodate individuals for various regions some of which was for religious belief. But when someone force their belief on others I feel like they should be knocked off their pedestal.


EDIT: Thanks to Liberal Veteran I have a new understanding. post # 6. If she was given the choice to let someone else to issue the marriage license and she isn't letting anyone issue them Kim can rot in jail.

However, she can be given choices: issue licenses to all qualified, consenting adults, resign, or sit in jail while the office runs without her.

Since it's basically her choice to remain in jail and thus absent herself from her duties, she has in essence, abandoned her position. At some point, the voters are going to wonder why they need to keep paying a clerk who no longer clerks.

I would imagine that she could be re-elected in near perpetuity by bigots who would view their vote as a way to make points with Jayzus. This is a down-ballot elected office where the outcome of an election could be strongly influenced by the emergence of an issue that has way larger implications than a recitation of the simple duties of a rubber stamper.

Nobody is forcing here to issue licenses. She could resign and never have to issue another license as long as she lives. Freedom doesn't mean life as you want without consequences. If she genuinely believes she can't fulfil her civic obligation she should resign. If she doesn't resign she should be in contempt until her term ends.

She could have allowed anyone else in her office to issue the license. She forbade them from doing so.

I think some people have a hard time grasping the idea that accommodation isn't the same thing "I should get to have things exactly as I want them".

The kind of accommodation she wants is UNREASONABLE accommodation to force her office to ignore the law.

Suddenly, she just wants to be exempt if others can issue the lecenses.

Question is, does she still mean those "others" must be in a different office or is she now saying she will let her deputies issue them?

Guess jail isn't turning out to be all that fun for Little Miss Bigot.

The most hilarious part of this is her husband and other protesters telling the governor "Do your job or resign!"

How many clerks would the state need to hire if they all demanded their own personal religious exemption and refused to do their jobs?

Her job is to uphold the law. It is legal for same sex couples to marry. She doesn't get to force her religion on the law. She shouldn't be given a special snowflake accommodation.

governance and morphing court decisions into something else. If she gets her way, we will see a significant erosion of the separation of church/state. This will be used immediately as precedence to allow the same or similar. Kim Davis is being used as a tool!

She should immediately resign.
Religious freedom means you do not get to force your religion on others. It is interesting that this woman finds her so called morals after she cheats on her husband and gets divorced three times, especially for someone who looks at marriage as some "sacred" thing. I guess her morals don't apply to her, they are used to judge others.

So she was offered an accommodation and refused it

She can stay in jail as long as she wants, but the judge's only concern is that the office issue the licenses

I expect now that the office is issuing licenses without her, the judge will haul her back into court and ask the question again

She can say no again and go back to jail; or she can get out of jail, go back to the office, again stop deputy clerks from issuing licenses, and go back to jail

Then again she can always tell the judge she'll let deputy clerks issue licenses, get out of jail, go back to the office, and do other clerky stuff there whenever deputy clerks are issuing licenses
