21. A number of years ago I did some contract work for a hispanic dating site.

It was a Spanish language site that quite openly aimed itself at hispanic men and women of all races. At one point I asked about the legality of limiting the site to a single ethicity, and this is what I was told:

It is illegal to limit a business to a single race or ethnicity. It is completely legal to create a business that is open to all ethnicities, but is useless to anyone outside of their target audience.

During their signup process, the site asked about your racial and ethic self-identifications. ALL races and ethnicities were allowed in, but here's the kicker: The focus of the site was on matching hispanics with hispanics, so the hispanic ethnicity was ALWAYS a positive criteria in the searches. If you weren't hispanic, you could sign up for the site but you would NEVER appear in the search results. Why? Because you didn't meet the criteria the other daters were looking for. Similarly, if YOU tried to search for other people yourself, all of your matches would have very low match scores (and matchs scores were visible to the other person when they were trying to decide whether to respond to your message). Because it was a hispanic dating site, the site placed a large weight on ethnicity and downmatched any ethnic mismatches. There WERE non hispanics on the site and it would occasionally match them with each other, but they were few and far between. Non-hispanics could use the site, but they were nearly always wasting their time.

In order to be legal, I suspect that this white people dating site probably works the same way. People from all ethnicities should be able to sign up (it's illegal to deny services based solely on race), but the search algorithms will make it nearly impossible for non-whites to actually find anyone. Because they don't match the average users search criteria, they won't find matching results and won't appear in another users results.

This is how nearly every dating service specializes without running afoul of the law. You are not allowed to DENY people access, but you're not required to make a site useful for everyone.
