(107 posts)Is it only closing person to person transactions? If so ill change the title. Regardless the fact that a prominent NRA member / republican is supporting him will make watching how RW media react to this really fun.

(18,585 posts)It (may) tighten the (already mushy) definition that the BATFE uses to determine that someone is 'in the business of' selling firearms. Right now, the BATFE takes a, "We know it when we see it" approach.
If I sell a couch on craigslist, does that make me a furniture store, requiring a business license, tax ID, and ADA compliant bathroom? Of course not. Similarly, Jim selling a firearm to his bowling buddy, or Phyllis selling off her deceased dad's collection doesn't make them 'in the business of' selling firearms.
No, I expect the BATFE to very publicly prosecute some schmoe who buys some guns cheap in one place, then sets up a table at a gun show a couple of states over and sells them for a profit- repeatedly.
No, if the BATFE tries to prosecute someone for a person to person transaction (that it otherwise legal under state law), all their attorney would have to do is file a motion to dismiss based on the fact that no law was broken.

Now what part of that do you so ridiculously take issue with? The part wherein you know that Obama wants universal background checks but can't make that happen with an EA?

Listen to Lutrell clarify that, in spite of Smerconish's trying to 'gotcha' him.
