The jury in the Steven Avery murder case may have deliberated improperly or considered highly inflammatory evidence that wasnt presented at trial, which could open the door for a new trial, a world exclusive In Touch investigation has uncovered.
In Touch spoke in person exclusively to 13 of the 16 jurors on the case (including alternates) and while some had little to say, four of them opened up and gave new details of what happened in the jury room for the case that spawned Netflixs viral 10-part hit, Making a Murderer.
One juror, when asked why they voted guilty and what they thought happened to murder victim Teresa Halbach, said Torture and rape. Then he shot her in the head. He cut her up and put her in a burn barrel.
The jurors comments are significant because no evidence of Teresa being raped and tortured was allowed in Averys trial. That information comes from a confession given by Averys nephew Brendan Dassey and was part of a pre-trial press conference given by prosecutor Ken Kratz.
The jurors explanation is a bombshell because it may now open the door for a new trial says a top attorney.
If a jury made its decision on incomplete, improper or withheld evidence then there are absolute grounds for a new trial, New York criminal defense attorney Bruce Baron explains. The jurors now may well be brought before an appellate review and ordered to describe whether they discussed certain inadmissible details they should not have brought into their deliberations.

Definitely worth a closer look.

I don't know that Avery is innocent, but Brendan got fucked over hard in this whole thing.

I firmly believe the blood in her car and the keys were planted.
It's outrageous.

(22,340 posts)but not how they said he did. There is no way he slit her throat on that bed and there is no blood. I don't believe Avery seems smart enough to put together a Dexter Kill Room.
He may not be innocent, but there is certainly reasonable doubt.

(3,818 posts)timing on the prosecutions part to make sure he didn't get the millions that were due to him and force him to settle for lawyers on this trial.
I think the series is a study in if "they" are out to get you, they will get you, especially if you have a 70 IQ level. The entire family wasn't smart at all by talking to anyone but I think they were overwhelmed by what was happening, as we all would be at having a murder/rape charge leveled at you days after depositions were taken from the people who are charging you.
The one thing that stood out for me is the going after of the nephew. How the cops tripped him up, how he was taken out of school 3 days in a row, how his mother wasn't allowed into the interview room, etc. That the child reads on 4th grade level and has no clue as to what is going on. Who is led every step of the way.
Every parent in America should watch that episode (4 or 6) with their children and show their child how cops will treat them if they are ever interviewed. They are not your friend and want to send you to jail and will lie every step of the way to make sure you go there.

P.S. The entire country is holding a cognitive dissonance about cops - we were trained from birth to "know" that cops are our buddies, our pals until they turn on you and go after you with every ounce the unions will allow. I think it is either episode 4 or 6 that shows this implicitly.

(63,212 posts)There's definitely a society-wide indoctrination telling us that cops are good and trustworthy. I confess that even believed the propaganda re: "a couple of bad apples" until just a few years ago, when reality became too ugly to deny.
It's appalling that the nephew's "confession" was considered admissible when it was so clearly coached and manipulated. And his initial fuckhead lawyer "Len" should be run out of town as an incompetent asshole.

(3,818 posts)7 out 4 (with 1 undecided) would have acquitted, but 2 jurors absolutely bullied the others into voting guilty? That these 2 jurors wore everyone down for a guilty verdict? One juror stated (the one that had a family emergency and left) stated that he felt very intimidated by these 2 in the jurors room.
If that fact wasn't there, it was on a talking head show that I happened to catch.
I think where the juror "got the info" was the 24/7 coverage that the prosecution blanketed Manitapoc (?) with before the trial, one of the tidbits dropped was the rape and torture of the victim. Avery's lawyers were successful in getting those charges dropped but you can't unring a bell, the prosecution knowing exactly what they were doing when they kept giving breaking news stories on the case for 18 months before trial.
