The incoming Senate convenes on January 3.

Obama remains president until January 20.

That's a significant factor here.

The nomination is not "held over" the gap.

The incoming Senate cannot "act on" a nomination put to the previous Senate.

Sorry, right now I'm not going to assume a Democrat is elected POTUS. That seems too speculative, especially given who I think both parties are going to nominate.

Although I suspect Debbie Wasserman Schultz running around insulting Millennials and calling for the majority of Americans who support pot legalization to be sent to prison, hasn't exactly helped our brand. I can't imagine it helps in Colorado, for instance.

Why not just go all the way?

This reminds me of the debate about extending the Bush taxcuts and then complaining about needing new revenues to fund the government.
