... Michael Ray Emry entered the courtroom in shackles. Magistrate Judge Jolie Russo asked if he wished to accept a court appointed public defender. Emry nodded and then mumbled yes.
Emry is charged with unlawful possession of a machine gun that is not registered to him and unlawful possession of a firearm with an obliterated serial number. Both counts carry a 10-year sentence. Russo asked if the defendant wished to enter a not guilty plea. After a nod from Emry, his lawyer replied, Yes, Your Honor.
On Friday, FBI agents seized a fully automatic machine gun during a warranted search of Emrys fifth-wheel trailer in Grant County. Emry was arrested and held in the Deschutes County Adult Jail before being transferred to Eugene.
Emry was a constant in Harney County during the 41-day armed occupation at the Malheur refuge. He reported for The Voice of Idaho, a pro-Bundy website he created. In court, there was no mention of the occupation or Emrys involvement in it. The judge ordered Emry to remain detained citing flight risk and danger to the community ...

(6,324 posts)To have not only been involved in that stupidity to begin with but then return home to your trailer, knowing that the FBI is probably coming to visit, and keep your illegally possessed machine gun on hand for them to find.
Since that is an item they just happened to luck upon when they paid him a visit you can but they have other charges in the works that they were working on when they visited.

(567 posts)Michael Emry just borrowed the fully automatic .50-caliber machine gun and didn't manage to get it back. Oh, and maybe it was FBI and ATF entrapment. After all its not against the law to borrow a fully automatic gun without telling the owner or build one because what part of "keep and bear arms shall not be infringed" do you not understand? No laws were broken here except by the Feds who made him do it!
Emry did not take the gun in question out of Idaho to sell it, it was to show Docs prospective buyer what the one he would build would look like. It appears this man Doc led him into this as he said he would need to SEE what Emry was going to build for the trade.
Mike still had the keys to the shop he previously worked at, it was his friends place and hadn't been used for years, his friend Jim Weaver did not know he had borrowed it, that appears to be Emry's biggest downfall. The gun is what Emry was asked to possible build one of.
Emry was not able to get the gun back to Idaho as he was being heavily followed the last three weeks and realized something was wrong, did he scrape off the serial number? It appears so, it also appears it was to possibly protect his friend who owned it. Why didn't he call Weaver to let him know he had it and couldn't get it back? Possibly because he already knew he was being set up at this point and did not want any appearance of involvement of Weaver? BUT, the main issue here, is once again, the Feds laid the plan in place and Emry stepped into the trap. Emry knows now he stepped into the Bear trap and took the bait laid out.
