If reasonable suspicion/probable cause exists to prevent someone from flying, a judge has to certify that.

(1,151 posts)I can see the need for a FISA (or similar secret) court in some cases though would like to see congressional oversight so they need more than "he visited Pakistan" to "convince" the secret court (one of my friends visits his mom in Pakistan once a year).
And if too many people are being put on the list for courts to deal with it we probably have a real problem or a problem with too many people put on the list without evidence.

(6,913 posts)Also, the Homeland Security folks don't want to have to go to court and explain just why they think you're dangerous. That could be, say, because they have a warrant and are listening to your phone calls but think there's a plot in motion and don't want to tip you off; or it could be they are tapping your phone without a warrant and don't want their asses sued. Or it could be they have you mixed up with somebody else and have no reason at all.
All in all, I think there should be some sort of hearing/ review process.
