First he'll point that he said to 'find' the 'missing emails,' that he never explicitly asked for anyone to hack anything. Second he'll point out that the 'missing emails' were of course deleted, so there is nothing for anyone left to 'find' or 'hack.'

He knows how to get close enough with what he says without actually getting himself into legal trouble.
