" A federal judge said Friday that he will refer Maricopa County Sheriff Joe Arpaio to the U.S. Attorneys Office to be charged with criminal contempt of court.
The decision comes after U.S. District Judge G. Murray Snow found that Arpaio intentionally violated various orders rooted in an 8-year-old racial-profiling case.
Snows decision, announced in a federal court filing, answers the key question looming over what has been more than a year of contempt proceedings: Was the disregard of orders a criminal or civil contempt-of-court violation?

OK hotshot, you get to see what the other side of the courtroom feels like. Pretrial incarceration would be particularly appropriate!

Speaking from experience, even with treatment from a dermatologist rosacea can still leave its ugly marks. 😢
Just wanted to put a word in for all of us who have rosacea and would be horrified to think people thought we were just chronic drunks due to broken capillaries.

(13,865 posts)He is coming to SC next week to speak at a rally for Cong Mick Mulvaney. His district probably has the highest percentage of Dem-leaning voters in a Rep district.
I wouldn't risk my money on a bet, but I think there could be an upset in at least one of our 6 GOP districts.

PHOENIX A federal judge on Friday referred Sheriff Joe Arpaio and his second-in-command for criminal prosecution, finding that they ignored and misrepresented to subordinates court orders designed to keep the sheriffs office from racially profiling Latinos ...
Mr. Arpaio and Chief Deputy Jerry Sheridan have a history of obfuscation and subversion of this courts orders that is as old as this case, Judge Snow wrote in his order.
Mr. Arpaio and Mr. Sheridan had also made numerous false statements under oath, Judge Snow wrote, and there is also probable cause to believe that many if not all of the statements were made in an attempt to obstruct any inquiry into their further wrongdoing or negligence.
The referral does not mean the sheriff will face criminal charges; it is up to federal prosecutors to decide whether to pursue the case. Still, if the prosecutors do not take the case, the judge could appoint a special prosecutor ...

... In his recommendation, the judge explained just how blatant he felt Arpaio's mistreatment of truth was.
"The test is not whether the testimony was perjurious or false but whether without the aid of extrinsic evidence the testimony is 'so plainly inconsistent, so manifestly contradictory, and so conspicuously unbelievable as to make it apparent from the face of the record itself that the witness has deliberately concealed the truth and has given answers which are replies in form only and which, in substance, are as useless as a complete refusal to answer.'"
The judge's referral of Arpaio for prosecution marks the first time in a 24-year career carpeted with lawsuits that Arpaio might be held personally responsible for misdeeds ...
