U.S. Customs and Border Protection officers and visa/esta issues

My niece has been living in Australia for the past 2 years. She's been living with her boyfriend who is a British citizen. They have just travelled back to the US for a month long visit. We also know he was going to propose to her while here. They met while he was a student here in the US, attending college on a soccer scholarship. He moved to Australia where his mother & stepfather live. He plays professional soccer and runs camps and teams for young kids.

They got to Boston today & just one plane trip to Pittsburgh. He was not permitted to enter the US, because the last time he was here, about 3 years ago, he overstayed his visa by 5 days. He is now stuck at Logan Airport, my niece is here.

There was some talk about his having to go back to England to reapply for a visa. I'm of the opinion that he should try to travel to Canada & start the process there, because Montreal and Toronto are both an easy drive from Pittsburgh.

Any suggestions out there?

I'm just pissed, because I know a hell of a lot gets by Customs and Border Protection & there's got to be an easy solution to this problem.

1. Best to return to England

I currently have a relative with a pending visa application and CBP is way behind in processing times. Our lawyer told us that there's been a serious uptick in applications since Trump won the nomination. What usually takes 3-4 months is now taking 5-6 months. Sorry..

2. I'm not a lawyer, but...

Based on a quick google search though, it looks when someone overstays how long they are permitted to be in the US listed on their I-94 form, that person's visa automatically gets voided. When that happens, the person must apply for a new visa and must do so at a consulate in their home country.

Given that your niece's boyfriend is a British citizen, it looks like he is going to have to go to Britain to sort things out. It doesn't look like a consulate in Canada (or even Australia) is an option.

3. fu.....ing agents sent him back to Australia.......

I know he should have done more research before he travelled here, but the treatment he got was ridiculous. They threatened him with arrest when he asked to see his girlfriend. They would not allow him to contact the British Consulate in Boston. When my sister-in-law called Logan to talk to him, she was told "he was asleep" He told her he had never slept while in custody at Logan.

He has an 8 hour layover in Qatar and his Mom is trying to get someone from the British Embassy to meet with and talk to him during this layover.

If you have exceeded your visa, you will not be able to enter. United States is very strict with its safety standards! You may need to apply for another type of visa to enter the country.

You should contact to the embassy or an immigration agency and tourism visas. I attach the link of the agency with which I processed my ESTA visa, is it possible that they can help!

he was able to reenter. They are now engaged, will be married in December & back in the States in 2018.
