to visit the United States, but I an American citizen don't need one to visit the EU?

(4,462 posts)it only permits a stay of 90 or fewer days for tourism or business.
There are rules and limitations, and due to security concerns and sensitivities about matters like illegal immigration, the visa rules are strictly enforced and unforgiving.
With respect to your niece's fiance, if he did in fact overstay his visa on his last visit, there was virtually no chance he would be permitted to remain without first resolving his status, and that is normally done outside the USA. It would not matter if he's Australian, British, Canadian, Mexican or anything else.

(4,033 posts)more info while he was in Australia. All of us, my brother, his wife, my niece and the soon to be nephew-in-law's family thought he could go to Canada & get the issues settled there. But he was not allowed to speak to anyone from the British Consulate in Boston & told to go back to Australia.

(11,949 posts)We have rules. He violated them. If you think he can just zip to another country and get a new Visa like buying a pizza, I think you may be disappointed. It may well be that getting married will be the only way he gets to enter the country legally.
He screw up big time. Despite what you might hear, getting into this country is not easy. And once you break the rules it becomes almost impossible.

(12,132 posts)But an aquaintance, US citizen, is now living in Cambodia with his new wife because the US wouldn't let her stay here. I think she's from South America but they moved there and built a pretty nice place on a lot of land. He can do his job from anywhere so he picked there. But he wanted here first. So yeah, getting in here sure isn't as easy as trumpleforeskin would have us believe.
