Trump Foundation lacks the certification required for charities that solicit money

Donald Trumps charitable foundation which has been sustained for years by donors outside the Trump family has never obtained the certification that New York requires before charities can solicit money from the public, according to the state attorney generals office.
Under the laws in New York, where the Donald J. Trump Foundation is based, any charity that solicits more than $25,000 a year from the public must obtain a special kind of registration beforehand. Charities as large as Trumps must also submit to a rigorous annual audit that asks among other things whether the charity spent any money for the personal benefit of its officers.
If New York Attorney General Eric Schneiderman (D) finds that Trumps foundation raised money in violation of the law, he could order the charity to stop raising money immediately. With a courts permission, Schneiderman could also force Trump to return money that his foundation has already raised.
The Trump campaign did not respond to a request for comment Thursday.
Schneidermans office declined to comment on whether it was investigating the lack of registration for the Trump Foundation. Schneiderman had previously launched an investigation of the foundation in the wake of reports by The Washington Post that Trump used his charitys money to make a political gift, to buy paintings of himself and to settle legal disputes involving his for-profit businesses.

(35,042 posts)That's how he gets away with so much. For the past 40 years, he's treated his fellow Americans as suckers, most likely laughing himself to sleep every night.
Meanwhile, nobody (prior to now) would assume that he would be bold enough to run a non-certified charity, or use other people's donations to line his own pockets, or promise money to vets with no intention of carrying through, or basically inventing fake employees to do his bidding, or paying zero in taxes. The list goes on and on. It's clear that everything Trump has ever said or done is probably a lie.

(17,374 posts)I spent about a year at a small local charitable foundation. Even we knew that it was supposed to be registered in our state. But it seemed the registration was kind of on autopilot and no one really checked if it was registered or not. The biggest problem is actually for donors. If the charity isn't registered with the state, some donors could believe it's not legitimate. Also contributions to it might not be tax deductible on the donors' income taxes. In my state, we have a flat income tax and no deduction available for charitable contributions, so the latter doesn't really matter, but that might not be the case in NYC and/or NY or any other state where donors live.

Besides, nobody ever wants to admit they were wrong. It takes MASSIVE character to admit you made a mistake or did something wrong. I've noticed that even the reluctant voters step forward to point out that "at least Hillary admitted she made a mistake and she's apologized. Trump has never apologized."

But donations to it are limited to 30% of his income - so, given that he directs money directly to the charity that was owed to him in order to avoid counting it as income, it is likely he is not complying with the deductibility limitation.

It looks like his candidacy is going to ruin his entire business. After all, these issues that are being raised would probably have never seen the light of day if he hadn't decided to run.

(22,394 posts)NYS lists all charities, foundations registered with the Charities Bureau. (Some are exempt, such as religious organizations.) Here's a link to the registry. https://www.charitiesnys.com/RegistrySearch/search_charities.jsp
The Trump Foundation's registration category is EPTL, which means it is registered under the Estates Powers and Trust Law. In order to solicit contributions exceeding $25,000, the entity also has to be registered under Article 7-A which allows it to solicit funds.
In other words, all anyone at the Trump Foundation had to do was check the public record to make sure it was properly registered to solicit funds. If the improper registration was just overlooked, they would have caught it when re-registering. It looks bad on several fronts for so many years to pass and no one caught it.
