Rep. Louie Gohmert (R-Texas), a tea party favorite, told reporters after the Supreme Court ruling that he would call for an investigation into Justice Elena Kagans involvement in the planning of the health care law.
"If it turns out that she lied in order to get on the court, and she did express opinions about the bill that she did participate in meetings about the bill, then it tells me she lied in order to get on the court and she should be impeached," he said.
Opponents of the law have argued that Kagan should not have participated in the vote because she was solicitor general during the passage of the law.
The law's supporters launched a similarly unsuccessful attempt to remove Justice Clarence Thomas from the case because his wife was actively trying to repeal the law.

(31,849 posts)First, Supporters of the law/Liberals did call for Thomas to recuse himself because of his wifes activities; rather the call was based in Thomas' benefiting financially from his wife and his own activities in opposition to the healthcare law.
Secondly, there is that false equivilence thing again. There is a real difference between extra-congressional calls for recusal and a congressman calling for an investigation into a Justice's involvement in the planning of the health care law.
