I think we all need to let go off the hope that Trump or his family will ever go to jail. He is POTUS and the US will not want to set a precedent by jailing a POTUS or members of his family. At worst they will be made to relinquish power and allowed to go on grifting people and enriching themselves

(96,943 posts)and, it would appear (by virtue of the thinking that such - jail - will never happen), tolerated.
So, really, any protest of a criminal president is an exercise in futility, since no matter what is said or done, there will always be criminal presidents in America's future.
I suppose I can see why jailing the street dealer for 50 years protects and defends our democracy while imprisoning a president that commits war crimes (or steals an election or uses foreign influence to control an election) would only damage our democracy. (Yes, that was sarcasm)
Oh, I get the fear that if one president goes to prison for actually committing crimes, then some Republican in Congress will try to do the same to another president for essentially non-crimes. It becomes about payback instead of the good of the country.
What a healthy democracy America has!
Where a necessary tool needed that really would help to protect and defend our democracy is considered an incredibly fearful prospect.
Nothing warped about that at all.
I suppose the ballot box is our only remedy - damn shame we can't even protect that. Yes, a mighty healthy democracy we have in America.

(163 posts)Thank you for the post. Punishment depends on severity of offense. High treason may not be a capital crime, but should carry mandatory times no matter if you are potus.

If the house and Senate GOP turn on him Trump is toast. The GOP will be desperately trying to blame Trumps and separate them from the GOP. This will fail, but an important thing for the GOP to try will be to say he's a criminal and they didn't know.

Somehow, I think the Dump will pick resignation over impeachment, if anything, to keep the more serious details from being shared during an open hearing.

I see where federal charges might be negotiated, if not already , to allow the institution of the presidency to save face ....
but those bringing state charges will not be as forgiving .....
And HRC probably has standing to bring civil RICO charges against 45 in state of NY...,
Especially if the hacking / russia propoganda / charges result in any criminal convictions of anyone in his entourage.....

An ex-US President, no matter how illegitimate, will never go to jail. The optics would be horrible on the global scale.
Trump going to jail benefits, Russia, China, Iran, etc. on the world stage. In the end, a few of Trumps chumps may go to jail, with a few getting commuted sentences (like Scooter Libby) and Trump will be disgraced. Perhaps his business will go belly up due to the negative stigma
...but then again, how do we know he's not already teetering on bankruptcy. Maybe that's the real reason he's not releasing his tax returns, he's broke. Just find it odd that someone who is supposed to be so successful in his real estate empire, he sure likes to license his name out on just about everything.

(4,377 posts)The optics of having a President proven to have commited crimes and not being jailed is far, far worse. It completely undermines any US claims to moral superiority or justice.

(7,350 posts)the USA has any claim to moral superiority or equitable justice. We've lost that a long time ago. And every time we seem to start making some inroads back, a Republican gets elected. And they view "moral superiority" as "might makes right", they are firm believers that the world respects force and nations that don't should be destroyed or punished. Hence why the asinine Cuban embargo or issues with Iran have gone on for so long, to give in is to say even the economic or military might of a superpower is not enough demand compliance.
We're a superpower, that's the clout we have to get other nations to tow the line. But we are also a superpower in decline (I know that sentiment won't be popular in some circles) and a disgraced ex-president will exacerbate the decline.
On Edit: Meant to say a disgraced ex-president in jail will exacerbate the decline.

Guys like Bannon could be vulnerable though.
Could Trump shoot someone 5th Avenue and not do time? If there was clear video and willing witnesses... maybe!

(9,714 posts)Unless Trump was an FBI informant, which is HIGHLY unlikely, he has been under surveillance for years and probably should have been brought up on racketeering charges before he even announced his candidacy. Could be someone else in his organization (ie, Felix Sater) was the mole that required protection and hence no moves at that time were feasible.
In any case, the international intelligence community has Trump in its crosshairs and no amount of politics is going to offer resistance to the truth about treason.
The well of evidence is likely miles deep and dozens of players at all levels of the government (and perhaps all parties of government as well) will be ensnared.
The culpability will be undeniable. The only issue at hand is what individual crimes were committed, and what sentences will be served.
Brace yourselves. And don't be afraid to believe in justice.

(8,138 posts)For one, the presidential pardon only works on federal crimes, not state.
However, one would think that a president could only pardon someone for something they had been accused or convicted of, but Ford pardoned Nixon for "any federal crimes he had committed or may have committed or taken part in" while president. So who know. The Constitution is pretty vague. "The President
shall have the power to grant reprieves and pardons for offenses against the United States, except in cases of impeachment" is all it says.
