Maybe I am wrong, but I was under the belief only with permission or from Law enforcement, can "tapes" be made...

....any conversation provided one is a party of that conversation without notice to the other parties involved. A non-party intercept is prohibited unless permission is given by at least one party to the conversation or a court order is obtained.

This varies from state to state - know your local laws on this matter.
