Austin American-Stateman:Brandon Vezmar, 37, of Austin filed the claim Thursday against his date. He is asking for $17.31, which was the price of the movie ticket to a 3D showing of Guardians of the Galaxy, Vol. 2, he told the American-Statesman Tuesday.
The 35-year-old woman, reached by phone Tuesday, said she didnt know about the claim against her. She asked that her name not be used.
I suppose the good news here is, since this is Texas, he could have just shot her...

(12,157 posts)Texting during a film is SOOOO ANNOYING to other people in the theater. Only thing worse would be making loud phone calls. The lighted screen is such a distraction to all patrons who spent their hard earn cash for entertainment.

In an interview with Variety posted online Wednesday, CEO Adam Aron said, "You can't tell a 22-year-old to turn off their cellphone. That's not how they live their life."

Aron, the former head of Starwood Hotels & Resorts who took the reins at AMC in January, acknowledged that the use of phones during movies irritates many people, and said AMC would have to find a way such as designated auditoriums for people who wanted to text to keep everybody happy.
This didn't reassure movie buffs, who flooded AMC's social media accounts with objections to the prospect of distracting blue screens glowing in a darkened theater, or what they viewed as pandering to an entitled, tech-obsessed generation, with many vowing to take their patronage elsewhere if AMC followed through with the idea.
Within hours, the company seemed to walk back the idea in a pair of tweets on its Twitter account, referring to the CEO's comments as, "Press reports we are considering test allowing texts," and specifying that any such test would take place "in a very few screens."

(12,654 posts)Sacrilege. Those tickets can be expensive, especially if they had gone to the Alamo Drafthouse theater for the drinks and a movie special.
But seriously, if he really wanted to enjoy the movie, her bringing up her phone to text while sitting next to him would be terribly distracting - especially if he had ADD or something like that. When I'm at a movie and people start taking out their "smart" phones to do whatever on them, it's immediately obvious to pretty much everyone sitting behind them, even if they're on the other side of the seating section if you're seated far enough back. It's as bad as being seated near that loud a-hole that saw the movie before and has decided everyone would appreciate running commentary that includes spoilers with their movie.
"Oh, oh - this scene is great. Just wait, he's going to say something dumb, and then there's going to be a jump-scare, and..."
On edit - not that I would take someone to small claims court over that, but people have been beat up and shot for texting or playing Facebook during movies in the past couple years. In fact, that should be one of the PSAs before a movie -
"This theater is not responsible for anyone's injury or death while using a Smart Phone during the showing of the main event. We cannot guarantee the actions of your fellow movie-goers. Please be Smart with your phone; turn it off until the movie is over."
It's stupid as well as annoying.

That said, suing for this is kind of ridiculous, but, hey, it's small claims court.
