The recorded comment was actually made by McCarthy. Ryan was just there to hear it. Later, its "reported" that Ryan said something similar.

And a couple comments like that wouldn't have any legal basis to exclude someone from the Presidency. You'd have to prove that he had first hand knowledge of actual payments to Trump.
