6. I think you mean circuit courts, since that's where these cases have been heard now.

But they might not take the case because there's no split in those courts' opinions.

5. Since there's no split between federal circuit courts, the 4th and the 9th both

having rules against the ban, it's possible they'l deny cert. and just refuse to hear it. They are more likely to take cases where there are different results in different circuits.
