Kushner's worried Mueller's going to "get the President"

As Kushner’s Russia troubles mount—last Friday the Senate disclosed that he had not turned over e-mails about WikiLeaks, a claim his attorney, Abbe Lowell, denied—insiders are again speculating, as my colleague Emily Jane Fox reported last month, about how long Kushner and Ivanka Trump will remain in Washington. Despite Kushner’s efforts to project confidence about Robert Mueller’s probe, he expressed worry after the indictments of Paul Manafort and Rick Gates about how far the investigation could go. “Do you think they’ll get the president?” Kushner asked a friend, according to a person briefed on the conversation.

According to two Republicans who have spoken with Trump, the president has also been frustrated with Kushner’s political advice, including his encouragement to back losing Alabama G.O.P. candidate Luther Strange and to fire F.B.I. Director James Comey, which Kushner denies. (For what it’s worth, Kushner’s choice of Strange prevented Trump from the embarrassment of inadvertently supporting Roy Moore.) Trump, according to three people who’ve spoken to him, has advocated for Jared and Ivanka to return to New York in part because they are being damaged by negative press. “He keeps pressuring them to go,” one source close to Kushner told me. But as bad as the Russia investigation may be, it’s not clear a New York homecoming would be much better for Kushner, given that his family’s debt-ridden office tower at 666 Fifth Avenue could be headed for bankruptcy.

I want a peaceful transition of power when he and his entire group are arrested for treason, conspiracy, etc. But that cant happen if he can thumb his nose at real patriots with his stolen power of pardon.

He is not legitimate.

federal prosecution takes jurisdiction over state, so the trump doj can just claim supremecy and petition a federal judge to make it the feds responsibility to prosecute.

then they can bury it after a pardon.

Or, they can use the power of right wing media to flip the ny gov to the R side, and the gov can pardon them.

The path is not certain in state court, even for the kids, by any means.

Nothing is certain, and unfortunately trump has power beyond limits of anyone except congress, and they won't act. ever. fuhgetaboutit.

The targets are facing both federal and state charges at once. State charges cannot be pardoned by the president. A new New York governor wouldn’t get in office until 2019, and Virginia just elected a Democrat. Trump is toast.

You can't be charged twice for the same crime. So if the charge is conspiracy to defraud, it can either be tried in state or federal court, but not both.

In almost all cases, courts will give preference to the feds and give them jurisdiction. That prevents the state from prosecuting the case. In the normal universe, it's used when the feds don't believe the state will fairly prosecute, as in the case of a white sherrif killing a black person in the south. The concern is that no matter how compelling the evidence, the prosecutor wouldn't mount an effective case due to sympathy for the defendent.

So all trump needs to do is get the doj to request jurisdiction. US attorneys in southern ny are in his pocket. easy peasy. then pardons will work. The trick is to find a ny statute which has no federal analogue. It has to be specific enough to not also be a fed crime. Not easy to do.

Oh, and ny has a long history of electing r gov's. What would happen if someone accuses the dem of raping them as a child 40 years ago? Don't think that can happen? It will. Over and over.

Correct me if I’m wrong, but I’m thinking that IF any pardoning were done (or could be done), would that mean that there could be NO pleading the 5th, if ordered to testify about anything?

If so, a quagmire awaits them. And they could be prosecuted for OTHER reasons. Unless, there’s an endless stream of pardoning...

when you accept a pardon. you can still remain silent. You can always claim you might end up in jeopardy by saying something false, so you can just shut up completely. As long as perjury is in play, you can't talk.
