To get this plea deal, Flynne has already sang like a songbird and Mueller has that testimony that can be used. To get a plea deal, the defendant has to make what is called a proffer and the proffer is given under oath and can be used later. A pardon would simply allow Mueller to call Flynne and to use his proffer to make the case.
