(52,277 posts)the supreme court has already ruled that's ok, at least when the president is a democrat.
it's still an open question as to whether a *criminal* case against a sitting president can move forward while in office, though.

(42,770 posts)Yes - because no one else seems to be standing up for her !! And I don't see his stupid remarks (with the annoying helicopter noise behind him so it looks like he's going somewhere important while it's probably really taking him to some golf course) as "acting on the authority of the office of president"
A private citizen can sue the president for conduct carried out prior to his inauguration, or which is genuinely independent of the presidential office. A private citizen cannot validly sue the president, however, when he is acting on the authority of the office of the president. If that is the case, the president is protected by the doctrine of absolute immunity.

But, the media has never asked any Republican to be specific when they run out a string of lies so guess it is not a concept for them (media).
When he defames someone like he just did, he should be asked for specifics. He cannot be allowed to continue lying his ass off.

(42,770 posts)Comey: Clinton did not lie to the FBI
By NICK GASS 07/07/2016 10:47 AM EDT
Hillary Clinton did not lie to FBI investigators during their probe into her use of a private server as secretary of state, FBI Director James Comey testified Thursday.
"We have no basis to conclude she lied to the FBI," Comey told House Oversight Chairman Jason Chaffetz (R-Utah) during one of the hearing's opening exchanges.
Chaffetz then asked whether Clinton lied to the public. "That's a question I'm not qualified to answer. I can speak about what she said to the FBI," Comey said.
Asked whether Clinton lied under oath, Comey remarked that she did not do so to the FBI. Asked whether he had reviewed Clinton's testimony from last October's Benghazi hearing in which the former secretary of state told Rep. Jim Jordan (R-Ohio) that "there was nothing marked classified on my emails," Comey said that he had not.

(11,175 posts)Even aside from all the reasons why he wouldn't be held liable at all, there's the question of damages. A plaintiff is injured by a defamatory statement to the extent that other people believe the defendant's statement, with the result that the plaintiff's reputation is damaged.
At this point, the only people who believe Donald Trump about anything are people who also already hate Hillary Clinton. My initial approximation of the damage she's suffered would be a big fat zero.
