So if Mueller goes and a Trump patsy is assigned to head up the investigation, what then?
Do all the charges evaporate?

(42,724 posts)First of all, Congress has no power to fire Mueller and Rosenstein isn't about to do so either.
Second, the contempt resolution isn't aimed at Mueller, it's aimed at Rosenstein.
Third, if Trump wanted to fire Rosenstein, so he could then try to appoint a successor who would then fire Mueller, he could've done so already.

(5,914 posts)I'm actually starting to think Comey already had everything that was really needed before he got canned. Which is why Mueller hired a bunch of prosecutors instead of investigators. Comey just handed over to Mueller the bankers' boxes he already had.
Mueller isn't going anywhere. Trump's Gang of Idiots are making it clear that their sole strategy from here on out is to catapult the propaganda and change the narrative on every bit of shit that rains down on them.

And yes this topic gets a bunch of discussion around here. Some are convinced Trump can not fire Mueller, others are convinced Trump can fire Mueller. The truth IS THAT NOBODY KNOWS WHAT WOULD HAPPEN IF HE TRIES IT.
The reason why nobody is quite sure either way is because currently there is no legal framework for 'Special Prosecutors'. The framework laws that outlined do's and dont's for Special Prosecutors expired in 1998. And Congress has not drafted nor passed the legislation needed.
So it's not just my opinion that nobody really knows what would happen, Constitutional lawyers (those in the know-not just political hacks) don't know what would happen.
At the end of the day if Trump does fire Mueller, or attempts to fire Mueller, IT WILL ULTIMATELY COME DOWN TO CONGRESS TO DO SOMETHING ABOUT IT.

In often gets mentioned that Sen. Blumenthal has drafted legislation to protect Mueller, BUT THAT DON'T MEAN JACK SQUAT BECAUSE IT HASN'T BEEN DEBATED NOR VOTED ON YET. IT ISN'T LAW, IT ISN'T EVEN CLOSE TO BECOMING LAW.
You may feel different, but I have no faith in Republican Congress people to stop Trump from firing Mueller. None. Nada. Ain't going to happen.
So, as I said, I fear nothing will happen if Donald Trump fires Mueller. Because it would take Republicans to do something about it. And they are detestable Shitheads who have their heads up their asses.
I am shocked he hasn't tried it already.

(9,074 posts)and Congress can hire Mueller back as a special counselor. Mueller is respected on both side of the isle so it's likely that could happen.
Finally I think Mueller can go to court to appeal the firing.

They needed to find a flaw so they could say that their actions are for cause.
Since they preparing contempt charges against Rosenstein it sure sounds like they are going to try and do something to get him out of the way.
I don't know if they'll succeed and I'm sure Mueller has prepared his investigation to withstand an attack like this but I'm still wondering, if they do manage to replace Rosenstein, the new guy would have the legal right to fire Mueller so I'm sure there would be an attempt.
It'll make a great movie in a few years.
