Breaking: U.S. Judge Orders Alabama Official to Issue Same-Sex Marriage Licenses

MOBILE, Ala. — A federal judge here ordered a county official in Mobile to issue marriage licenses to same-sex couples.

With the ruling, Judge Callie V. S. Granade of Federal District Court, enjoined the probate judge in Mobile County, Don Davis, from refusing to issue licenses to gay couples seeking to wed.

“Judge Davis may not deny them a license on the ground that Plaintiffs constitute same-sex couples or because it is prohibited by the sanctity of marriage,” the decision said.

The ruling came shortly after Judge Granade heard arguments from lawyers for four same-sex couples seeking to marry and a plea for clarity from the lawyer of a local probate judge. The decision was expected to send a signal to judges statewide who are caught between a federal ruling and an order from Alabama’s chief justice.

they just can't except change. And for others, I really seriously believe some of them get enjoyment from persecuting others for no valid reason than to have their enjoyment of making others suffer.

the probate judge there has begun issuing the licenses.

I suspect that should the judge call out the various probate judges they will fold and start issuing the licenses.

They know if they fail to comply a specific, direct order they risk being held in contempt of court, arrested and hauled off to detention.

Our beloved Guvnuh has come down on both sides of the law.
Like Pontious Pilate, he has washed his hands.
Won't act against probate judges who comply with the law or those who don't.

An ordained minister who showed up at the Atauga County courthouse to marry same sex couples was arrested by the county sheriff (at the behest of the probate judge) for "disorderly conduct".

The taxpayers of Alabama will be paying out for huge lawsuits.

Except for Mobile, all of the other urban areas of AL have complied from the outset, including Montgomery (where the AL Supreme Court sits) and Gadsden, where Roy Moore is from. The federal judge who made the the initial ruling presides in the Southern district, which includes Mobile. I'm beginning to wonder if Mobile County's probate judge held out on purpose (to force the issue) knowing there would be problems between our crockpot chief judge and probate judges who would be confused. To be a probate judge in AL, one does not have to possess a law degree. I have practiced law in AL for a number of years, and would not be surprised if there was a "wink, wink" agreement to hold out and force the issue.
