'Emergency motion' seeks release of Y-12 protesters; cites medical condition of 85-year-old nun

Attorneys representing Plowshares protesters Michael Walli, Greg Boertje-Obed and Sister Megan Rice today filed an emergency motion with the Sixth U.S. Circuit Court of Appeals seeking their release from federal prison.
The motion references the recent appeals court decision that reversed the protesters conviction on sabotage charges. That decision said it appears that sentences for the other charges in the case would be substantially less than the time already served by the three.

Among other things, the motion cites Rices medical condition. She is currently incarcerated at a federal prison in Brooklyn, N.Y.
She is suffering from a range of health problems, which, although not grave, have been causing her pain and discomfort for the past 12 months, the emergency motion states. She hopes for release so that she can seek medical attention to address these problems.

An 85-year-old nun and two fellow Catholic peace activists in prison for vandalizing a uranium storage bunker should be released immediately, their attorneys say.
The 6th U.S. Circuit Court of Appeals last week overturned a sabotage conviction against Sister Megan Rice, Michael Walli and Greg Boertje-Obed for their July 2012 actions at the Y-12 National Security Complex in Oak Ridge, Tennessee. The court left in place a lesser charge.
In a Thursday motion, attorneys say resentencing will take weeks and the activists have already served more time than they are likely to receive. They have been in prison since May 2013.
The motion asks the court to either order their immediate release or send the matter to the lower court.
The motion says Rice suffers from health problems that are not grave, but are causing her pain.
