San Antonio man gets 7 years in prison for sex with girl in Honduras

HOUSTON --
A Texas man who worked for the Department of Defense in Honduras must serve seven years in a U.S. prison for having sex with a 13-year-old girl.
William Curry McGrath of San Antonio was sentenced Monday in Houston. The 55-year-old McGrath in April pleaded guilty to engaging in illicit sexual conduct with a minor in a foreign place.
McGrath was a DOD civilian employee, working as director of the Network Enterprise Center at Soto Cano Air Base in Comayagua, Honduras.
Prosecutors say McGrath, who was in Honduras from late 2012 to March 2014, met the girl and began having sex with her. McGrath gave the teen money and gifts in exchange for sex.

(16,191 posts)He isn't being accused of violating Honduran law. He's being accused of violating American law. Our law says that it is a federal crime for any American to have sex with ANYONE under the age of 18 outside of the United States. It doesn't matter whether it was consensual or not, or whether the sex was perfectly legal in that country. In France, a 17 year old is perfectly capable of providing legal consent, and there's nothing illegal about a 17 year old French girl and an 18 year old French guy having sex with each other. But if an American 18 year old sleeps with a French 17 year old while touring Paris, he's committing a federal felony and can be prosecuted when he returns to the U.S.
For what it's worth, I'm pretty sure Honduran law says it's illegal to sleep with 13 year old girls anyway. It's just not particularly relevant in this case.
ON EDIT: I was off in a detail. The legal basis of these protections is the Protect Act of 2003. It makes if a crime to PAY for sex with anyone under the age of 18 overseas, or to have ANY kind of sex with anyone under 16, no matter what the local law is. The American 18 year old in my example above would only be committing a crime if he paid the French 17 year old for the sex. Because the age of consent in France is 14, it would still be possible for an American teenager to commit a crime by engaging in legal and consensual sex in France, but not using the ages I gave above.
