Connecticut Governor To Block People On Watch Lists From Buying Guns

Connecticut Gov. Dannel Malloy (D) announced Thursday he intends to sign a "common sense" executive order prohibiting individuals on government watch lists from buying guns. "This is a moment to seize here in America," Malloy said during a press conference. "It is incumbent upon leaders at all levels of government to protect its citizenry."
Pending approval from the federal government to access their databases, including the "no-fly" roster, Malloy said he will sign an order requiring those who apply for gun permits to be screened against government watch lists. Those who are on such lists would be banned from purchasing handguns, shotguns, rifles and ammunition.
"If Congress will not act, we in the states will," Malloy said.
He added there would be an appeals process for people who say they have been unfairly placed on government watch lists.

(68,360 posts)at this point it would be surely malfeasance for Malloy to do otherwise. I know it's largely moot since people can drive here after they get their guns somewhere else but Malloy has to show some backbone and do what he can do to protect the people of our state.

The No Fly List is in the news this week, just in time for the ACLUs argument in federal court on Wednesday in its five-year-long challenge to the lists redress process.
Last night, in response to last weeks tragic attack in San Bernardino, California, President Obama urged Congress to ensure that people on the No Fly List be prohibited from purchasing guns. Last week, Republicans in Congress defeated a proposal that would have done just that. "I think its very important to remember people have due process rights in this country, and we cant have some government official just arbitrarily put them on a list," House Speaker Paul Ryan said.
There is no constitutional bar to reasonable regulation of guns, and the No Fly List could serve as one tool for it, but only with major reform. As we will argue to a federal district court in Oregon this Wednesday, the standards for inclusion on the No Fly List are unconstitutionally vague, and innocent people are blacklisted without a fair process to correct government error. Our lawsuit seeks a meaningful opportunity for our clients to challenge their placement on the No Fly List because it is so error-prone and the consequences for their lives have been devastating...
...We disagree with Speaker Ryan about many things. But hes right that people in this country have due process rights. We want to see them respected.

(5,455 posts)Since the ability to purchase a firearm is a Constitutional right (regardless of what the gun control extremists think), it requires due process to remove that right from a person. I can see a court ruling against Malloy.
This may not turn out the way Malloy wanted

Anyone on this watch list would just get someone who isnt on it to purchase guns for them. Democratic party leaders (Obama, Feinstein, Malloy, etc) are just kicking the can down the road and not coming up with real solutions to this problem.
Private and commercial sales of semi auto weapons should be illegal (no exceptions).

(14,704 posts)I agree completely. But at this point, I'm glad to see ANYONE making ANY MOVE at all to try to stop the madness. I'm tired of our "do nothing" policies for fear of hurting the widdle feewings of the gun humpers and the NRA.
