Colorado Supreme Court voids two city voter-approved fracking bans

(Reuters) - Colorado's Supreme Court on Monday struck down voter-approved bans on fracking and the storage of fracking waste within the cities of Fort Collins and Longmont, ruling they conflicted with state law.
Voters in Longmont approved a ban in 2012, while voters about 30 miles north in Fort Collins approved a five-year moratorium in November 2013, drawing legal challenges from the Colorado Oil and Gas Association, an industry trade group.
Lower courts subsequently sided with the association, invalidating the Fort Collins moratorium and the Longmont ban.
The Colorado Supreme Court affirmed the rulings in separate decisions. Justice Richard Gabriel said the Longmont ban could result in uneven and potentially wasteful oil and gas production and affect the rights of the owners of those interests.

High court strikes down Fort Collins' halt to fracking
The Colorado Supreme Court on Monday struck down Fort Collins' five-year fracking moratorium, a long-awaited decision that could have statewide implications for the controversial oil and gas recovery method.
The court also ruled against Longmonts voter-supported ban on hydraulic fracturing, the widespread practice of injecting a high-pressure mix of water, sand and chemicals underground to break open formations and recover oil and gas.
In its first judgment on local fracking bans and moratoriums, the court called both laws invalid and unenforceable because theyre preempted by state law.
Fort Collins voters supported the moratorium in 2013, and Longmont's ban was voted into place in 2012. But the Colorado Oil and Gas Association sued both cities in separate cases and won in the lower courts, resulting in the bans being thrown out.

I won't ever vote for anyone who voted for Fast track, votes for these "trade" agreements, or traveled the world shilling the TPP as the gold standard.

The citizens put before for the voters a ballot initiative to "ban fracking" and then some black suits in court room thought other wise based on property rights, not health issues for the common good of the community and the wild life-------------

The high country in this state and along the entire Rockies when I lived there was absolutely beautiful, but when they started to frack in Wyoming, the land around the sites became dead zones-------------and the under ground water became polluted--------------this is amazing.
