A 13-year-old Ohio girl escaped a basement Wednesday night where her stepfather and stepbrother kidnapped her and kept her shackled for almost a year, police said.
Timothy Ciboro, 53, and Esten Ciboro, 27, chained her by her ankle to a support beam in their Toledo home, fed her scraps of old or spoiled food and forced her to use a bucket filled with ammonia as her toilet, according to court documents cited by The Blade.
Toledo police said her stepfather and stepbrother were jogging in a park when the girl used a spare key she had found and kept hidden to get away around 9 p.m. Wednesday night. A neighbor dialed 911 after the girl ran to her home nearby the Ciboros' house on Noble St. in North Toledo.
The father and son were arrested early Thursday. They face charges of endangering children by torture and cruel abuse and kidnapping to terrorize or to inflict serious harm, WNWO-TV reported.

(26,236 posts)you would think that the stepfather would automatically have legal custody of her in that case unless the mother filed a missing persons claim with the police about her daughter in which case kidnapping charge would make more sense.

According to the laws of Ohio, a person is guilty of kidnapping if any person, by force, threat, or deception, or, in the case of a victim under the age of thirteen or mentally incompetent, by any means remove another from the place where the other person is found or restrain the liberty of the other person, for any of the following purposes:
To hold for ransom, or as a shield or hostage;
To facilitate the commission of any felony or flight thereafter;
To terrorize, or to inflict serious physical harm on the victim or another;
To engage in sexual activity, as defined in section 2907.01 of the Revised Code, with the victim against the victims will;
To hinder, impede, or obstruct a function of government, or to force any action or concession on the part of governmental authority.
If any person, by force, threat, or deception, or, in the case of a victim under the age of thirteen or mentally incompetent by any means knowingly do any of the following is also guilty of kidnapping: Restrain another of the other persons liberty;
Hold another in a condition of involuntary servitude. -

I believe it is better to establish trust and openness in private interview settings where such children can understand their rights and know that they are not alone and isolated at the mercy of their family. The welfare workers should stay in touch and the child should be given instructions on how to reach out for help.
Also, what did the girl's school know? Welfare workers should let schools know which children may need extra support and an open dialogue.
This is one of the areas where Republicans are so very wrong in not wanting any "interference" in family "relationships." One of the purposes of government is to secure the basic rights of its citizens, no matter their age. Parents (and of course step-parents) do not "own" their children.
