Trump Foundation ordered to stop fundraising by N.Y. attorney general’s office

The New York attorney general has notified Donald Trump that his charitable foundation is violating state law — by soliciting donations without proper certification — and ordered Trump’s charity to stop its fundraising immediately, the attorney general’s office said Monday.

James Sheehan, head of the attorney general’s charities bureau, sent the “notice of violation” to the Donald J. Trump Foundation on Friday, according to a copy of the notice provided by the press office of state Attorney General Eric Schneiderman (D).

The night before that, The Washington Post had reported that Trump’s charity had been soliciting donations from other people without being properly registered in New York state.

According to tax records, Trump’s foundation has subsisted entirely on donations from others since 2008, when Trump gave his last personal donation. This year, the Trump Foundation made its most wide-ranging request for donations yet: it set up a public website, donaldtrumpforvets.com, to gather donations that Trump said would be passed on to veterans’ groups.

trying not to get too over-confident but I would love to think this is the beginning of Trump totally unraveling especially at this stage in the election. Not a lot of time to recover.

Damn. I wonder if he has enough attorneys on retainer to handle the mess of the last week. Suing the NY Times. Suing the attorney/accountant who confirmed his signature on those leaked
State tax forms. Responding to the NY AG's office for the Charitable Foundation.

What's next? I can hardly wait to find out!

It's interesting - the foundation filed paperwork with the office for many years (https://www.charitiesnys.com/RegistrySearch/show_details.jsp?id={412967CE-87D6-4FAF-A0E2-58CF382F8F53}). Looking at the 2014 form only EPTL was selected:
EPTL
EPTL registrants are registered under the New York Estates, Powers and Trusts Law, which governs charitable activity in New York State.
Examples of EPTL registrants include but are not limited to New York-based charitable organizations, out-of-state charities that conduct business or maintain assets in New York, and New York trusts and estates that have a present charitable interest.

There is an option to select 7A or "dual - both 7A and EPTL.
7A
7A Article 7-A registrants are registered under Article 7-A of the New York Executive Law, which governs the solicitation of contributions (including grants) from New York State sources (including without limitation residents, foundations, corporations and government agencies).

Examples of Article 7-A registrants include but are not limited to fund raising professionals (professional fund raisers, fund raising counsel and professional solicitors) and New York-based or out-of-state charitable organizations, social welfare organizations, fraternal organizations, unions, business leagues, social clubs or other nonprofits that solicit contributions from New York State sources beyond their own membership.https://www.charitiesnys.com/RegistrySearch/glossary.jsp#glossarypage


If they had selected dual there would be no problem. It seems the Trump Foundation was intended to be a family foundation - one that a family contributes to and then distributes money to other charities.


On the 2014 form there is this interesting section:
If you are a 7A only or DUAL filer, submit the applicable independent Certified Public Accountant's Review or Audit Report:
Review Report if you received total revenue and support greater than $250,000 and up to $500,000.
Audit Report if you received total revenue and support greater than $500,000
No Review Report or Audit Report is required because total revenue and support is less than $250,000


And:

Is my organization a 7A, EPTL or DUAL filer?
7A filers are registered to solicit contributions in New York
under Article 7-A of the Executive Law (7A')
- EPTL filers are registered under the Estates, Powers & Trusts
Law (EPTL) because they hold assets and/or conduct
activities for charitable purposes in NY.
- DUAL filers are registered under both 7A and EPTL


So if the Trump Foundation filed as DUAL they would have had to submit either a Review Report or an Audit Report - which may be public documents and could be revealed. We KNOW Trump wants to keep all his financial shenanigans hidden so this may be why his people never corrected the filings once Donald started soliciting money from the public.

What about this past Jan when he skipped the debate ( Jan 28 2016 )

"Trump told reporters, "Probably I won't be doing the debate. I'm going to have something else in Iowa, do something where we raise money for the veterans and the wounded warriors. We're going to do something simultaneously with the debate."

Since the Trump Foundation was established under the laws of the State of New York they are supposed to obey the laws of that state. The New York AG only has jurisdiction over those laws and cannot enforce them anywhere else.

If he had filed one way, the raking in of outside donations would be legal. Except if he filed like that he'd have to have oversight and file Reports as proof. So he filed only EPTL, then raised funds like it was Dual. The best of both worlds, when you're a scamming tax felon.

New York State and New York City. He violates laws but never is fined or charged. Do all the rich get away with these crimes? Why wasn't he caught spending money in Cuba? I guess laws are only for the lower classes of people in the USA
