GOP recount filing seeks stay, review by full panel

LANSING — The Michigan Republican Party early this morning filed emergency motions with the U.S. 6th Circuit Court of Appeals, seeking a stay of a federal judge's order that started a statewide presidential recount in Michigan on Monday and asking for an "en banc" review of that order by all the judges of the 6th Circuit in Cincinnati.

Normally, appeals go to a three-judge panel of the court. A stay from the 6th Circuit would halt the Michigan recount until appeals judges have a chance to review Monday's order by U.S. District Judge Mark Goldsmith.

The question for the appeals court to consider, lawyers for the Michigan GOP said, is whether Green Party candidate Jill Stein is constitutionally entitled to a statewide recount "without any evidence that the election was affected ... by fraud or other impropriety."

The party gave notice Monday it would appeal the ruling Goldsmith made after a rare Sunday hearing in Detroit.

he should be held in contempt, he is hiding behind the color of law to circumvent a election that over rides everything. She is a a federal presidential candidate on the ballot is asking for a hand recount, it is her right to ask for one, she is stating with facts that the machines or the election officials did not do there job properly, or they willfully broke the law, this will go to the U.S. Supreme Court under an appeal if he (Shutte for brains) loses, which he will, and he should be held in contempt

Kobach and his Crosscheck organization influenced states to violate voting requirement for a given state, he was an outside influence, and had no business interfering with registers voters names while sitting in Kansas, he should be under indictment under the Rico Act, in my opinion, he knowingly set up an operation to defraud voters the right to vote in there state of registry from across state lines where he sat.

not one defeat, except in North Carolina when the bigot McCrory lost. New Hampshire where Ayotte lost, both fascist .

But every state, if there democrats in those thirty states, they should file a lawsuit, why not? Its there vote were they counted properly? Who knows?

What is really amazing is the voting schedule, you have an election on the second Tuesday in November, then you have the electoral college confirming the votes in less than forty -five days, why?. This country gave and put die on the finger thing in Iraq when they checked the voter rolls, so they could vote, not in this country we have fascist(s) open-ling trying and succeeding to prevent people from voting, what part of the picture am I missing here.

Why not hold the election lets say in May, right before the kiddies get out of school and vacation begins, then when December 19th comes rolling around, and if there are "issues" they can be investigated.

Kobach in my opinion from what I said earlier, should be under investigation for voter intimidation, he has no business telling other states how to set up some operation to work against voter rolls in another state, that his not his function, his theory is a failure and has not proven voter so called fraud. Kansas looks like it is going to sell off everything that isn't tied down and is publicly owned, or whats left of them, he is a fascist and should be called one, he is threatening my right to vote and yours, if you have a first name and last name of someone else in another state



Again I hope that the democrats put forth Garland for a vote when they have the majority for the five minutes that Biden is in charge of the senate, before swearing in the new senate, McConnell can't stop it, its under old business.
