Preet Bharara Is Said to Refuse Order to Step Down as U.S. Attorney.

Source: nyt

Preet Bharara, the Manhattan federal prosecutor who was told to submit his resignation along with 45 others on Friday, has no plans to do so — forcing a potential showdown with President Trump and the Department of Justice.

Mr. Bharara, whose office is overseeing a case against a top aide to Gov. Andrew M. Cuomo and an investigation into people close to Mayor Bill de Blasio of New York City, has told several people that he did not hand in a resignation on Friday, as he was ordered to do by the acting deputy attorney general, Dana Boente.

He also does not intend to do so over the weekend, he said in conversations with associates, a move that could force the hand of the Trump administration.

'Someones' are thinking about how to remove him from office. Trying this: Section 4.

Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.

Thereafter, when the President transmits to the President pro tempore of the Senate and the Speaker of the House of Representatives his written declaration that no inability exists, he shall resume the powers and duties of his office unless the Vice President and a majority of either the principal officers of the executive department or of such other body as Congress may by law provide, transmit within four days to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office. Thereupon Congress shall decide the issue, assembling within forty-eight hours for that purpose if not in session. If the Congress, within twenty-one days after receipt of the latter written declaration, or, if Congress is not in session, within twenty-one days after Congress is required to assemble, determines by two-thirds vote of both Houses that the President is unable to discharge the powers and duties of his office, the Vice President shall continue to discharge the same as Acting President; otherwise, the President shall resume the powers and duties of his office.

And a tool is not discarded unless it is broken.

Trump provides the cover that the Koch Brothers and associates need so that their tools, Paul Ryan and Mitch McConnell, are free to do their work.

I cannot imagine the GOP taking this step unless Trump becomes so erratic that they must remove him.

IF we're lucky, the WORLD will recognize the misery he's causing, which will be felt worldwide, FORCING GOP's hand. (Of course, would be 'nice' if U.S. electorate were able to recognize the misery on it's/our own, but due to miserable lack of education in 'recent' years, not too likely.)

'One of New York’s top elected Republicans voiced support for Mr. Bharara on Saturday.

“Good for Preet, he is doing the job he was appointed to do!” Assemblyman Brian M. Kolb, the State Assembly minority leader, wrote on Twitter.

Assemblyman Steven F. McLaughlin, a Republican who was fond of calling for draining the swamp in Albany long before Mr. Trump embraced that expression, had urged Mr. Trump and Attorney General Jeff Sessions to reconsider on Friday.

“Big mistake,” he wrote on Twitter.'

the way he was "supposed to" by custom. Asking them all to resign is nothing new and perfectly within 45's rights, but Bharara knew he wouldn't be asked to stay and forced them to fire someone investigating them. Good. Like this guy. Glad he's not after me.

Preet Bharara was asked to stay on by Trump. Mr. Bharara told Trump he would consider it, then accepted.

http://www.reuters.com/article/us-usa-trump-bharara-idUSKBN13P2BI

(Reuters) - Preet Bharara, the top federal prosecutor in Manhattan known for pursuing a series of cases targeting public corruption and crime on Wall Street, said on Wednesday he has agreed to remain in his post after Donald Trump becomes U.S. president.

Bharara, appointed to his position by Democratic President Barack Obama in 2009, told reporters following a meeting with the Republican president-elect at Trump Tower in Manhattan that Trump asked him to stay on during his administration and he accepted. Trump takes office on Jan. 20.

"We had a good meeting," Bharara said. "I said I would absolutely consider staying on. I agreed to stay on."

Frankly, this was grandstanding by Bharara. Bill Clinton canned a pack of US attorneys almost immediately, and that precedent goes back to Reagan. This really isn't anything nefarious, and certainly doesn't amount to a hill of beans compared to the corrupt conduct otherwise seen in the Trump administration. I wish the press would focus on the truly nasty conduct, and let this kind of standard political fare go.
