A federal judge in Washington has dismissed a lawsuit alleging that Hillary Clinton's lax security surrounding her emails led to the deaths of two of the Americans killed in the 2012 attack on the U.S. diplomatic compound in Benghazi, Libya.

In a ruling Friday, U.S. District Court Judge Amy Berman Jackson tossed out the wrongful death claims as well as allegations that Clinton essentially slandered the parents of the deceased by contracting accounts the parents gave of their children's deaths.

The suit was filed last August by Patricia Smith, the mother of State Department information officer Sean Smith, and Charles Woods, the father of CIA operative Tyrone Woods. The case was brought weeks after Patricia Smith took to the stage at the Republican National Convention in Cleveland and delivered an emotional speech blasting the 2016 Democratic presidential nominee and for failing to save the four Americans who died in the Benghazi attack while she was secretary of state: Smith, Woods, CIA operative Glen Doherty and U.S. Ambassador to Libya Christopher Stevens.

"The Court finds that Secretary Clinton was acting in the scope of her employment when she transmitted the emails that are alleged to give rise to her liability," Jackson wrote in her 29-page opinion. "The untimely death of plaintiffs’ sons is tragic, and the Court does not mean to minimize the unspeakable loss that plaintiffs have suffered in any way. But when one applies the appropriate legal standards, it is clear that plaintiffs have not alleged sufficient facts to rebut the presumption that Secretary Clinton was acting in her official capacity when she used her private email server.".......................

through then the congressional republicans who refused to pay for the extra security requested by the state department at the time, would have moved to the front of the line for liability.

Hell, the wrongful deaths that the bush administration caused from their WMD lies, to ignoring the PDB warning about 9/11 would have been right up there

As the OP said, a perfect example of a witch hunt

Joe McCarthy would have be proud of these asshole republicans

For the purposes of the suit, "it...does not matter whether Secretary Clinton used a private email server lawfully or unlawfully. Instead, the relevant inquiry is whether Secretary Clinton’s electronic communications with State Department personnel about official business during her tenure were within the scope of her employment as the head of the State Department," the judge said. "Her actions – communicating with other State Department personnel and advisors about the official business of the department – fall squarely within the scope of her duty to run the Department and conduct the foreign affairs of the nation as Secretary of State."

11. State Department Investigation?

What I'm wondering is what happened to the State Departments investigation?..it was not against any law for Hillary to have her on server.it might have broke policy but so did Comey.the FBI said all of the e-mails that contained classified information that was on Hillary's server originated from the State Department.the question I have is why didn't the people at the State Department know it was classified?..if they had never sent it to Hillary's server it would have not been that big of a problem.an investigation into why the people at the State Department did not know those e-mails contained classified information could have helped Hillary.I guess we will never know but my guess is other agencies had classified the information and not the State Department.it was not only Hillary's server that was not secured for classified information it was also the State Departments server state.gov that was not secured for classified information...it is a proven fact that state.gov has been hacked but no proof exist Hillary's server ever was.

announced in late August of 2015 that Secretary Clinton's use of a private server did not break any laws, rules, or regulations. For some reason, this doesn't get mentioned .

I played EVE Online many years ago, and was never part of one of the big groups, but I watched the intergroup politics like they were an audience participation soap opera. (Which they were.) So I knew of Sean Smith as his Vile Rat persona. It's not an understatement to say he invented the EO diplomatic corps. He was really good at his job, and his loss is a tragedy to everyone who knew him, but most especially the people he cared about most: his wife and children, his colleagues, and his friends. Patricia is not on that list and hasn't been for many long years.

Heather, Sean's wife, and his children, are his family. His immediate family was notified about his death per State Department procedure, and Heather has been perfectly fine with the State Department's support and provided information. That's what started Patricia's vendetta -- she was offended that she was no longer considered his immediate family. That appears to have been Sean's wish: like all federal employees, he had to file regular emergency contact information and designate his survivors. He could have listed his mother as well as his wife. Clearly, he did not. If the State Department didn't contact her, that was intentional. Patricia has also been harassing Heather for Sean's remains. So I don't have a lot of sympathy for Patricia. She's inserted herself into this as a means of harming the woman her son chose and making herself the center of attention. She's being used, but she also wants to be used. Grief doesn't excuse that.

I feel pity for this woman, because it's pretty clear that she did something that ruined her relationship with her son and her daughter in law. But that's on her. I don't pity her for being used. For that, she enthusiastically volunteered, and her son would be appalled. Or not. Because when one grows up with a parent who has to have all of the oxygen in the room, one gets used to their tantrums.

Shame on FOX and others on the Right for using her for their own personal motives. I feel sorry for her, but she needs therapy. Even her son's widow won't have anything to do with her.

Of course the suit was going to be dismissed, Hillary acted in the pursuit of her job as SOS. The lawsuit had no merit.
