The 21 youth plaintiffs suing the federal government over climate change will have their day in court, with a date for the trial now officially set for February 5, 2018.
Despite incessant efforts by government and industry to prevent our case from moving forward, the date is set for trial, Alex Loznak, a 20-year old plaintiff from Oregon, said in a press statement. Having seen some of the most damning evidence to be presented at trial, I am confident that our claims will prevail.
The case is the first to use a theory known as atmospheric trust law, which argues that the federal government, through actions like fossil fuel subsidies, has actively undermined the youths right to a livable climate. Atmospheric trust law is based on an old legal doctrine that holds that the federal government must preserve certainly commonly held elements, like shorelines and waterways, for public use. Applying public trust to the atmosphere, the plaintiffs argue that the government must also take steps to preserve the atmosphere from rampant greenhouse gas pollution.

We will have to see what Neil Gorsuch, thinks, since he's one of the 6,000 year creationist thinkers

That's basically what he thinks and has proven this over and over. He'll also be a complete toady to Drumpf and has already promised loyalty to him, count on it!

(24,695 posts)Gosrsuch on the other hand is a hypocrite du-jour, since he would have let a truck driver die in below freezing truck, this terminal thinking of having people die so that other person makes a buck off that death, will be telling in this case, and if he writes an opinion like he did in the truck case and the driver, he should be removed and impeached. So far in his opinions he has sided for death, every time
These young human beings have a pretty strong case, they are basically saying if companies can have this air, and this water why can't I for my future , I still applaud them
