Warren: Trump Can't 'Override' Consumer Protection Deputy

Source: The Daily Beast

President Donald Trump on Friday named his own interim leader of the Consumer Financial Protection Bureau just hours after the agency’s outgoing director picked a different person to take on the role, triggering an apparent showdown. Outgoing director Richard Cordray—an Obama appointee—initially said Leandra English, the agency’s new deputy director, should serve as acting director until a permanent leader is chosen. Hours later, Trump appeared to override the decision, however, naming Mick Mulvaney, the director of the White House Office of Management and Budget, as the interim leader. The move has caused concerns among Democratic lawmakers who fear Mulvaney, an outspoken critic of the CFPB, will overhaul the agency. Sen. Elizabeth Warren, one of the architects of the consumer agency, disputed Trump’s pick and said Dodd-Frank financial reform law stipulates that the agency’s deputy director should take over the agency’s leadership in case of a vacancy. Warren insisted that “Leandra English is the Acting Director under the Dodd-Frank Act,” saying Trump can’t “override that.”

Never occurred to me before but someone who owns his own business can tend to be a dictator. The difference is that the economy tends to be a leveling force.

27 Psychiatrists and Mental Health Experts Assess this "ABUSER", this malignant narcissistic sociopath.................There are millions of woman, and men, and for that matter children that are in relationships of having an "ABUSER"...............well this sexual predator has abused employees, woman, men and for that matter children--------------------and got into the most powerful position on the planet and he looks at everyone and thing as a toy, because no one has ever told him NO, and his parents are the main culprit in this malignant narcissistic sociopath.

So be be prepared for the next temper tantrum on his platform.

His meltdown or hissy fit his emotional outburst, usually associated with children or those in emotional distress, that is typically characterized by stubbornness, crying, screaming, defiance, anger ranting, a resistance to attempts at pacification and, in some cases, hitting and other physically violent behavior. Physical control may be lost; the person may be unable to remain still; and even if the "goal" of the person is met, he or she may not be calmed. A tantrum may be expressed in a tirade: a protracted, angry, or violent speech.

This asshole has a narcissistic sociopath pattern-------------and he is dangerous and we presently have a Congress that is using this deflection to pass legislation to harm the people of this country.............................

Just another attempt to snub the pesky rule of law and destroy democratic rules...Putin has shown the American racists and fascists the path.

that even with an "acting", the President has the right to "fill up vacancies".

BUT of course Article II Sect. 2 has this provision -

<...>

but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments.

https://constitutioncenter.org/interactive-constitution/articles/article-ii

which is apparently what was done in the law that established the CFPB.

with the tax giveaway to the rich to deal with, the CR that expires December 8th, and you know... vacation.... and there are all sorts of ways to gum up the works - especially for this agency. I expect Elizabeth Warren is dusting off the old playbook.

Right click on the image from the Federal Register. That will bring you to Warren's twitter and posting.

Scroll down a bit and find "NavyJack" who, apparently, does not like Warren. At all. Move and hold your cursor over his name and up will pop his very brief bio.

The courts will decide the statutory interpretation that governs and that will be the end of it. A
Actually, it'll probably end before the courts finish with it, since all Trump has to do is send Mulvaney's nomination to the Senate and they'll confirm him and at that point it won't matter anymore.
