Stormy Daniels sues Trump, says ‘hush agreement’ invalid because he never signed

Adult film star Stormy Daniels sued Donald Trump Tuesday, alleging that he never signed the nondisclosure agreement that his lawyer had arranged with her.

The civil suit, filed in Los Angeles Superior Court and obtained by NBC News, alleges that her agreement not to disclose her "intimate" relationship with Trump is not valid because while both Daniels and Trump's attorney Michael Cohen signed it, Trump never did.

She’s claiming that his lawyer starting binding arbitration proceedings. Maybe he’s doing other things to try to silence her.

She’s probably claiming tortious interference and would be asking for injunctive relief, at a minimum.

8. It's a defensive move.

Think of the fact that if Trump, Cohen, et al, elect to sue her 1st for breaking the NDA, this filing gives her standing in court as the 1st claimant. It's not that uncommon for one party to file suit before the other does, especially as this has already played out in the press to some extent.

I don't remember if Cohen threatened her in public (via the press) or not but he may have done so in a cease and desist letter directed to her or her attorney. Either way, she's getting max mileage out of this w/o any harm to her....so far. It would btw be very difficult from my reading for Cohen ot counter-sue and win since he's the one who has talked up the payment.

9. Trump's attorney continues to threaten legal action against her to shut her up

The suit attempts to quash those threats (a well known Trump tactic) and to allow her to speak freely about the year long affair. She has been somewhat circumspect in the way she talks about it now. An interview with her was published in which she gave specific details about the affair but that was before this agreement.

Basically, the porn star is outmaneuvering the best negotiator and businessman who ever lived (and keeping his money).

Heck, his own lawyer claimed that he fronted the money as a gift. How is Trump going to sue Daniels for breaching a contract that he is also claiming that he never authorized and did not sign?

Just because a powerful person purchases sex doesn't give that person the right to terminate the civil rights of another.

If there is a signed contract then a judge or agreed upon arbitrator can decide. If the contract is not signed there are no restrictions other than the normal libel/etc.
