ICE says man detained driving his pregnant wife to hospital had outstanding warrant for his arrest

An immigrant in the U.S. illegally who was detained by federal immigration officers in San Bernardino this week while he was driving his pregnant wife to the hospital had an outstanding warrant for his arrest in Mexico on homicide charges, authorities said Saturday.

Joel Arrona-Lara was driving his wife, Maria del Carmen Venegas, to a local hospital Wednesday for her scheduled cesarean section when he was apprehended by Immigration and Custom Enforcement agents.

“Mr. Arrona-Lara was brought to ICE’s attention due to an outstanding warrant issued for his arrest in Mexico on homicide charges,” ICE said in a statement. He is currently in custody pending removal proceedings.

Normally, the US Marshals have arrested foreign fugitives in the country. (Edit to add) The unit of ICE that arrested Arrona-Lara is the National Fugitive Operations Program.

If they are within 100 miles of a border that can be asked for ID but only if they did something illegal...or so I thought those we're the rules. Another DUer gave me this link but I don't see how this is legit. Did ICE run their license plates because they had nothing better to do?

Border Patrol, nevertheless, cannot pull anyone over without "reasonable suspicion" of an immigration violation or crime (reasonable suspicion is more than just a "hunch&quot . Similarly, Border Patrol cannot search vehicles in the 100-mile zone without a warrant or "probable cause" (a reasonable belief, based on the circumstances, that an immigration violation or crime has likely occurred).
The Border Patrol often ignores this regulation and, aside from limiting interior checkpoint locations to within the 100-mile zone, rejects any geographic limitation on agents' authority. At least two federal circuit courts condone Border Patrol operations outside the 100-mile zone, federal regulations and Supreme Court precedent notwithstanding.

But police run license plates constantly. The cameras in their vehicles can detect and interpret plate numbers so they are constantly checking them.

I am solidly in all of the privileged groups (white, anglo, male, middle age) and I was once pulled over for a tag issue. Somebody had screwed up tag numbers on an unrelated vehicle sale so it looked like my tag was on the wrong vehicle make/model. I had the WASP privilege so I could convince them the car wasn't stolen.

(And yes, I do have a hunch ICE is in a major bout of CYA,) but if it's true, this guy did deserve to get busted.

made no mention of probable cause or an outstanding warrant, just that he and his wife were approached and asked for ID -- which, as I said, struck me as odd.

And they caught the right guy (not just someone with the same name or someone who looked like him), this is not a story where we’re going to be able to effectively make the case that ICE is harassing immigrants.

Why wouldn't ICE have said this initially - made a big splash of their success?

Why can't ICE provide details of the outstanding warrant? ACLU says no record of warrant under that name.

How does ICE know they have the right person - if he didn't have ID?

Why didn't ICE call ambulance or take pregnant wife to hospital?

But if it turns out this is accurate, no one is going to care if he was stopped without probable cause, or probably even that they left his pregnant wife stranded. There are probably hundreds of stories that fit the argument better that don’t have the potential to backfire. If someone is looking for a story to make as a “poster child” for the issue, I don’t think this one is a winner.
