On Monday, Supreme Court Justice Brett Kavanaugh promised to exercise his role on the nations high court with no bitterness following the brutal confirmation battle in which he was accused of sexual misconduct by multiple women.
Kavanaughs paean to non-partisanship doesnt mean that widespread bitterness, scorn, and acrimony wont follow his name. It seems, however, that exactly the opposite is true. Quite literally.
The url BrettKavanaugh.com now directs users to several resources for sexual assault survivors.
A project of non-partisan judicial reform organization Fix The Court, the websites splash page features a black-and-white image of the U.S. Supreme Court emblazoned with the phrase: We Believe Survivors.

Kavanaugh has a right to control the commercial use of his name (even if money being raised {follow the links} goes to benefit the greater good). (Most jurisdictions define commercial use to include raising money for non-profits)
Who knows whether he'sll decide to do aything about it. Just pointing out the law.

(33,992 posts)It's cybersquatting, which can be - but is not necessarily - connected to trademarks. It can also be connected to right of persona (which includes preventing others from making money by using your hame).
Trademark rights grow out uf the use of the mark as a source identifier.
If I had been using the name Amazon for my mail-order business before Amazon was a twinkle in Jeff Bezos' eye - but never registered it, I would still be able to prevent him from registering Amazon as his mark in connection with mail order businesses. Use generates the rights to the mark, not the process colloquially known as trademarking something.
Fair use is far less broad than most people believe. In this case, the site using Kavanaugh's name and persona to raise money (if you follow the links you get to a donate button). That
is presumptively bad faith and makes it even harder to defend.

But the Supreme Court can decide the issue.
