Trump officials to challenge authority of judges to issue national injunctions

Vice President Pence on Wednesday announced that the Trump administration will challenge the ability of federal district court judges to issue nation-wide injunctions.
Pence argued to supporters at an event hosted by the conservative Federalist Society that the Trump administration has been unfairly targeted by injunctions issued by lower courts.
The vice president said that in the coming days, administration officials will seek pathways to put the issue before the Supreme Court.
So I say to all those gathered here, for the sake of our liberty, our security, our prosperity and the separation of powers, this era of judicial activism must come to an end, Pence said. The Supreme Court of the United States must clarify that district judges can decide no more than the cases before them.

Most Americans are not paying attention and do not fully understand what is happening to our real liberty, freedom and democracy because of being lulled. Even those who support Trump do not recognize this for what it is.
Pence rails about the threats to liberty, security, prosperity and desperation of powers in this era of judicial activism all while he, tRump and the rest of these thugs threaten our liberty, etc, via a stacked SC established for the sole purpose of judicial activism. The hypocrisy and projection are appalling.
These are dangerous days. Will Americans rise to defend our Constitution or unknowingly aid and abet with vacuous complacence?

Its scary.....I live in a solid red county in Indiana and I would not be comfortable with a bumper sticker reading "Impeach Trump now "and park in a Wal-Mart parking lot or a grocery store lot because I could come out of store and find a broken window or something..... I'm serious.
Here's the deal though..If this would have happen back in the 70's with Nixon Thousands would have been in the Streets Republicans and Democrats... We are dealing with Russian propaganda on the social networks and propaganda from the Repuke we have legislative branch fighting back and that too is scary..if the SCOTUS sides with Barr and Trump its over.

If trump isn't t stopped soon we will not be a Democracy anymore. Trump supporters will then see how cruel and corrupt he really is then, and it will be too late for them.

(395 posts)than anything real. Federal district court judges were created as an extension of the supreme court because SC judges no longer had time to ride their "circuit". Which means they have the same power on a national level. Even without that the logic is silly so district court judge can only put an injuction on things in his district that would mean there is no such thing as the federal level.
It's just more babel for his supporters and the fools that keep giving him moeny.

Unfortunately, as youve no doubt reflected on today, the kind of government control that our Founders were concerned about is too often exerted by the administrative state in this country. And its been emerging in recent years in the federal judiciary in the form of nationwide injunctions.
These orders are issued by federal district court judges on a broad range of issues from national security to immigration, from border security to healthcare reform. And these orders prevent the entire Executive Branch from enforcing a statute, a regulation, or a policy on a nationwide basis. And they apply everywhere, to everyone, granting relief even to those who are not parties to a case.
As Justice Thomas wrote last year in a decision upholding President Trumps ability to enforce our immigration laws against nationwide injunctions, Justice Thomas said nationwide injunctions, in his words, take a toll on the federal court system preventing legal questions from percolating [and] encouraging forum shopping, and making every case a national emergency for the courts and the Executive Branch.
Its remarkable to think a Supreme Court justice has to convince four of their colleagues to uphold a nationwide injunction, but a single district court judge can issue one, effectively preventing the duly elected President of the United States from fulfilling what he believes is a constitutional duty.
This obstruction at the district level is unprecedented. Studies show that theres not a single example of a nationwide injunction in the first 175 years of our nations history.
Although we received some good news last night that the Ninth Circuit stayed an injunction to allow our administration to continue our remain in Mexico policy, addressing the crisis at our southern border, the truth is, our administration has been unfairly hit with more nationwide injunctions than the first 40 American presidents combined.
Nationwide injunctions issued by federal judges prevent the Executive Branch from acting, compromising our national security by obstructing the lawful ability of the President to stop threats to the homeland, where he sees them.
These injunctions undermine the rule of law and the separation of powers that are central to our nations founding, that lie at the very heart of our Constitution.
And so I say to all those gathered here, for the sake of our liberty, our security, our prosperity, and the separation of powers: This era of judicial activism must come to an end. (Applause.)
The Supreme Court of the United States must clarify that district judges can decide no more than the cases before them. And its imperative that we restore the historic tradition that district judges do not set policy for the whole nation.
In the days ahead, our administration will seek opportunities to put this very question before the Supreme Court to ensure that decisions affecting every American are made either by those elected to represent the American people or by the highest court in the land. (Applause.)
