NRA-funded Texas congressman dismisses bipartisan 'red flag' laws as unconstitutional

A day after President Donald Trump endorsed red flag laws to “make sure that those judged to pose a grave risk to public safety do not have access to firearms, and that if they do, those firearms can be taken through rapid due process,” an NRA-backed Texas Republican congressman is pushing back.

In a Fox News interview on Tuesday, Rep. Brian Babin (R-TX) attacked the popular bipartisan proposal as an “infringement of constitutional rights.”

Babin, a third-term congressman who has already received thousands of dollars in campaign contributions from the National Rifle Association (NRA) and the firearms industry, proposed instead that Washington enact his own bill that would promote threat assessment but not expand any gun laws.

During the interview, Babin was asked about efforts by lawmakers such as Sens. Lindsey Graham (R-SC) and Richard Blumenthal (D-CT) to enact red flag legislation to keep guns out of the hands of people like those responsible for two mass shootings over the weekend in El Paso, Texas, and Dayton, Ohio. Babin acknowledged that such laws might help keep people safe, but decried them anyway.

Did you read asshole how the one guy had to unclip is load from the gun so that he wouldn't be shot.................because the "good guys " had no clue who is safe...................because you have open carry in your state...............so asshole can you tell who is bad or a good guy if they stand up in line...........................don't think so asshole................you have blood on your hands.....................you really do...........................

The problem with the red flag laws is that it avoids due process, below was the ACLU's position

"But gun control laws, like any law, should be fair, effective and not based on prejudice or stereotype. This rule met none of those criteria.

In this era of “alternative facts,” we must urge politicians to create laws based on reliable evidence and solid data.

The thousands of Americans whose disability benefits are managed by someone else range from young people with depression and financial inexperience to older adults with Down syndrome needing help with a limited budget. But no data — none — show that these individuals have a propensity for violence in general or gun violence in particular.

To the contrary, studies show that people with mental disabilities are less likely to commit firearm crimes than to be the victims of violence by others.

Data show that young, white men are most likely to be mass shooters — the issue that politicians care about most, despite accounting for a tiny fraction of gun violence. And men under 35 commit most murders. Shall we enter all young men into the national database? The statistical correlation with gun violence would be stronger."

What are the criteria to be certified dangerous? dangerous to who society? himself?
