Mulvaney Will Defy House Impeachment Subpoena

Source: New York Times

WASHINGTON — Mick Mulvaney, the acting White House chief of staff, reversed gears on Tuesday and said he will follow President Trump’s order to defy a House subpoena and refuse to testify as part of its impeachment inquiry.

“After further consideration, Mr. Mulvaney does not intend to pursue litigation regarding the deposition subpoena issued to him by the U.S. House of Representatives,” his lawyers said in a notice filed in court. “Rather, he will rely on the direction of the president” and government lawyers “in not appearing for the relevant deposition.”

The decision was the latest twist in an odd subplot in the impeachment drama. While other current administration officials have either obeyed the president’s order not to cooperate with the House or defied Mr. Trump and testified anyway, Mr. Mulvaney had sought a third route by seeking to join an existing lawsuit asking a court what he should do.

The plaintiff in that existing lawsuit, Charles M. Kupperman, a former deputy to John R. Bolton when he was the president’s national security adviser, wanted nothing to do with Mr. Mulvaney and fought his attempt to be added to the litigation. After a judge indicated on Monday that he was inclined to side with Mr. Kupperman to keep Mr. Mulvaney out of the suit, Mr. Mulvaney withdrew his request and said he would file a lawsuit of his own. Then he changed his mind again.

Why is there no punishment for this? Can I do this if I get subpoenaed?? This is beyond frustrating to me. What is the point of a subpoena if you can simply ignore it and have no punishment whatsoever?

That they would have to get a court date, argue that he must comply. Then the potential witness can appeal. All of this can take months if not over a year. So because Democrats think they have enough evidence from the witnesses that did comply to just move forward without them.

But what I have a problem with is why they can't walk and chew gum? I think they should still charge them with refusing to obey a lawful supeona. Have it work its way through the courts, even if the final charges and punishment is dealt out years after. So that these weasels will know that there is a price to pay for their noncompliance. All this handing out of free passes only gives courage to others to also thumb their noses at Congress.

judicial processes, legislative processes all these types of actions by people defying the law will have said to Congress(HOR) specifically and the American voting public in general, our administration is a dictatorship and the law be damned. It seems that if it's the purview of the U.S. Marshalls, House-Senate SAA, Secret Service, someone!! That they should real busy rounding up and arresting lawbreakers. Seems like that to me, but what do I know? After all this, I can say nothing really.

I've heard the justification for not putting the time and effort into enforcing subpoenas, and this is one area where I strongly disagree with Pelosi and Schiff. Subpoenas mean NOTHING if the entire fucking tRump crime syndicate knows they won't be enforced. "We'll give you a demerit if you ignore it" is sending totally the wrong message, throw a few of their sorry asses in jail until they testify.
