Feds back away from Stone sentencing proposal

The Department of Justice is backing away from its sentencing recommendation of between seven to nine years in prison for Trump confidant Roger Stone, a department official told the AP.

The official says there had been no contact with the White House over the decision, though President Donald Trump tweeted early Tuesday calling it “a very horrible and unfair situation” after the recommendation was made in a court filing Monday evening.

The official said the recommendation was extreme and excessive, and disproportionate to Stone’s offenses. The official was not authorized to speak publicly and spoke to the AP on condition of anonymity.

The Justice Department plans to refile the recommendation later Tuesday, the official said. It wasn’t clear how much prison time it would seek. Stone was convicted in November of a seven-count indictment that accused him of lying to Congress, tampering with a witness and obstructing the House investigation into whether the Trump campaign coordinated with Russia to tip the 2016 election.

Looks like DoJ wants Stone to skate on the witness tampering enhancement to the sentencing guideline.

Defense lawyers also said that the sentencing guidelines actually suggested a term of 15 to 21 months.

The DOJ, the Washington U.S. Attorney’s office, and the White House did not immediately respond to requests for comment from CNBC.

The sentence of 87 to 108 months first recommended by the prosecutors in the case for Stone mirrored what they said is recommended by federal sentencing guidelines, which are calculated according to a formula that takes into account the severity of the crime, the type of conduct involved and prior criminal history.

A large fraction of the recommended sentence, as much as 62 months, comes from a so-called enhancement under federal guidelines related to witness tampering.

The DOJ can make any recommendation they want...but this is just it....its a recommendation. The Judge could see things differently.

DOJ can recommend...but the final decision is up to the judge...and I seem to recall that Stone tested her patience a few times!

Judge Amy Berman Jackson has a lifetime appointment...and she doesn't work for Barr!!!

With this, and the firings of the Vindmans, we are seeing the immediate results of Trump's acquittal. Absolute lawlessness...

At this point, I wouldn't be surprised if he works with the DOJ to frame and jail his political opponents, or even has them assassinated.

Again, throwing it back to Congress in the same way as Mueller...if that's what it takes NOW, just something else for McConnell to block...

Not to mention all those "back channel" records Barr is setting up for dear dictator to screw over House oversight.

I can't bear the indecency and the perversion of justice of this cabal much longer!
